Abstract

Polygamy is as marriage between a man and two or more women (four women in maximum); it has legal ground in the Islamic law. The study used judicial normative and descriptive methods. The result of the study showed that the implementation of polygamy in the Islamic society is violated since many men have more than four wives, and it is contrary to the provisions in the Islamic Fiqh, KHI (Compilation of the Islamic laws), and Law No. 1/1974 on Marriage . Its legal consequence is that the marriage is considered as adultery or an illegitimate marriage. Children who are born from polygamy of more than four wives are also considered as illegitimate children. They do not have any nasab (lineage) with their father or his descendant although they become the responsibility of their biological parents. Keywords: Marriage, Polygamy, Fiqh, UUP (Marriage Law)

Abstract

The real form of communication is the use of cellular phone which depends on cellular operator as a telecommunication service provider. To improve its capacity and quality, the operator construct telecommunication tower. The operator constructing a tower on the rooftop of a building makes a lease agreement with the building owner. The agreement was studied two rooftop lease agreements between the operator and the owner of the buildings located in the city of Medan. The problems which arise in the rooftop lease agreement were why the rooftop use agreement is made between the telecommunication company and the building owner in the city of Medan, how this agreement is implemented, what legal protection that can be given to the owner of the building and the community living around the tower constructed as stated in the rooftop use agreement, and what constraint are faced and how to solve them in the implementation of the agreement. Abstract

Its development adoption at this juncture not just separation of the juridical relationship with her biological parents, but by this time the problems of adopted children already developed to the problem of the Division of the inheritance. The existence of adopted children in succession at this point still being debated are always discussed, both in the circle of politicians, academics, and law enforcers. A will is a thing that can not be separated from the law. A will relating to the rights of power or responsibility that will run after someone dies, for example, a person she talked to other people in order to help educate his son later, paying debts or return an item ever dipinjamnya, on the other hand is also an obligation for people who can afford against children who have no parents, as a humanitarian mission and practice the teachings of the religion. Abstract

Copyright as a part of HaKI (Intellectual Property Rights) is very personal and exclusive rights for composer or holder of a copyright to announce or distribute his creation without reducing any limitation according to the prevailing regulations. The thesis uses judicial normative and descriptive analytic methods. Copyright is in the hand of the composer although it has been given to another party. Besides that, it is prohibited to change the title and subtitle although it has been given to another party. Legal consideration of the Supreme Court in copyright dispute in the Ruling No. 254K/PDTSUS/2009 states that the transferring or being transferred of copyright has to be done in specific way by its composer and user, and the license has to be signed by the composer although it has been in the hand of another party. Abstract

Wali nikah (male next of kin and guardian whose consent is required for the marriage of a girl or woman) is one of the pillars of marriage, and it is written in Article 14 of the Compilation of Islamic Law.  Rasulullah SAW said that “the marriage is not valid without the (present of ) wali” meaning that the marriage agreement is not valid without the present of guardian. In general, the one who becomes the wali for the marriage is wali nasab. If the wali nasab is adhal (fair), the guardianship can be represented by wali hakim. The transfer of guardianship from wali nasab to wali hakimis regulated in Article 23 (1) and (2) of the Compilation of Islamic Law. The purpose of this study was to describe the factors causing the incident of wali adhal, the validity of marriage if the wali adhal occured based on the decision No. 215/Pdt.P/2011/Pengadilan Agama Jakarta Selatan, and the status of marriage resulted from the wali adhal marriage. Abstract

A credit card is one of the facilities for facilitating buying and selling   transaction which involves a bank or a company as the publisher, credit card holders, and sellers. In practice, however, the use of credit cards is determined by the good faith of the parties concerned in taking their responsibilities since it is not possible that there is a default in the contract conducted especially by the credit card holders. The aim of the research was to explain the purchase agreement by using credit cards, the implementation of good faith principle by the credit card holders related to the purchase agreement, and the legal consequences of using credit cards when there is a default by the credit card holders. The research used descriptive analytic method and judicial normative approach which described and analyzed the implementation of good faith principle of credit card holders related to purchase agreement. Abstract

A will is a message from someone in the form of statement orally or  written form with an object or rights to another person or an institution which is valid after the giver who makes the statements dies. From the judicial viewpoint, a will is one-sided legal action or one-sided statement. In other words, there is no achievement contract from the receiver side which can be done without the presence of receiver and it can be done in oral or written form in front of two fair witnesses. Although the testator can revoke his will as long as he is still alive, the revocation and accomplishment should be based on the prevailing regulations. The Supreme Court agrees with the Ruling of the Religious High Court, Semarang, that the will is valid and binding. Although a will is one-sided legal action, in the accomplishment when someone has given his property to someone, and  he wants to give it back to another person, the revocation of the will should be firmly and clearly stated. Abstract

An applicant who requests for a new right of uncertified land and/or building (the first land registration) to the Land Office, Binjai, is required to pay PPh Final PHTB and BPHTB. The levying on PPh Final PHTB is based on UU PPh No. 36/2008 in conjunction with PP No. 71/2008 on the Levying on Income Tax of the Income from the Transfer of Title on Land and/or Building. The levying on BPHTB is based on UU PDRB No. 28/2009 in conjunction with the Regional Regulation of Binjai No. 2/2011 on BPHTB. After the land is certified and transferred, the seller is required to pay for PPh Final PHTB and the buyer is required to pay for BPHTB so the land owner pays for PPh Final PHTB twice and pays for BPHTB once. Logically, it is impossible for the land owner to sell his land twice or more, and thus he has to pay for PPH twice or more. Abstract

Mafqud is a missing person who is not known whether he is still alive or dead. In the Islamic fiqh, determining the status of mafqud is very important since it is related to many aspects, and one of them is inheritance law. Meanwhile, the testator, of course, needs to know whether his heir is really dead because it is one of the requirements for a mafqud to get inheritance.When a mafqud leaves an inheritance but the heirs are unknown, it will be managed by BAZNAS (the National Tithe Board, particularly in Aceh, it is managed by Baitul Mal . Judge’s legal consideration in determining an heir in the Ruling of Sharia Court No 137/Pdt.P/2013/Ms-Bna, based on the testimony and was validated byGeucihik of Gampong Lampaseh No 470/LPS/MRX/2013 and the petitioner who had Al-Hawasiy lineage (next of kin) with the testator because besides the evidence, determining an heir can be seen from the requirements for being an heir which one of them is the death of a person (testator), either in reality or in legality (for example, he is considered to be dead). In determining the fourth biological child dies because of earthquake and tsunami, the judge , in his legal consideration  based on the Death Certificate No 12/IV/LPS/MRX/2013.

Abstract

A child is the world’s life ornament who becomes the parents’ pride as it is stated in Al-Quran (QS, AL-Kahfi:46), “Wealth and children are an ornament of life of the world. But the good deeds which endure are better in thy Lord’s sight for reward, and better in respect of hope”; therefore, we have to obey the command of Allah to take care, raise, and educate our children. The research was judicial normative and descriptive analytic, based on general legal theory which was applied to explain a set of other data. The theory used in the research was the theory of legal protection for under-aged children (before mummayiz), looked after by their guardian. The cancellation of the right to look after under-aged children is because the parensts are considered not legally capable so that the judge abolishes their rights, the judge appoints the priority of the family who has the rights to look after under-aged children. It is recommended that psychological factor and the security of the children who are looked after by their guardian should be considered, the Religious Court’s Ruling should be implemented according to the prevailing procedures by putting forward the principle of negotiation and consanguinity in the transferring of the rights.
