Abstract

Globalization which is identical with free market, free competition, and transparency has great impact on HaKI (Intellectual Property Right) protection in Indonesia. HaKI is a legal instrument which provides protection of the right for a person on his creativity and realization of his intellectual work and gives a right owner to enjoy the economic benefit from his right ownership. Copyright and Industrial Design are a part of HaKI. The case of dispute between Copyright and Industrial Design which has the same legal basis usually occurs in society which is known as cross regime. Protection for copyright is automatic and real expression in realization and without any registration which is given to the copyright holder, while protection for industrial design is not automatic because it is given according to the registration on new design. In the future,  it is recommended that respect for the right holders be given, either to copyright holders or to industrial design holders, for their works so that there will be no dispute between them. Abstract

This article analyzes the regulation on adultery, status and legal consequences of marrying pregnant woman because of adultery from the perspective of the Islamic law and Law No 1/1974 on Marriage. The research used judicial normative and descriptive analytic method. The regulation on adultery is stipulated in the Islamic law. Meanwhile, Law on Marriage only regulates the status of a child from adultery in civil law with his mother and with his mother’s relatives. Legal status in the Islamic law of a marriage with pregnant a woman because of adultery is valid for the man who has made her pregnant, while there is different opinion about the validity of marriage of a man who does not make her pregnant. According to the Marriage Law, a marriage with a pregnant woman is valid when it is done according to the couple’s religion. The legal consequence of marrying in this case regarding to the child in relationship in kinship, guardianship, inheritance, and livelihood with his parents or the man who has married his mother since the pregnant woman is married legitimately. Abstract

Since the Agrarian Law No.5/1960 was issued, all types of dualism in land rights In Indonesia, which was inherited from the Dutch colonialism, have conversed the ownership of land, along with the adat land. According to the verdict of Padangsidimpuan District Court No. 06/Pdt.G/2004/PN.Psp, the plaintif was the heir of the land which was obtained from the Landraad verdict with the land as an adat land. Meanwhile , the plaintiffs complaint was referred to the illegal at by the respondent which was evident in the Court hearing that they had issued the Declaration of Heirs, the Letter of Notifiation of Heir, and controlled the land rights owned by the plaintiff. Later, it had been transferred to another respondent so that it was evident that the transfer caused written judicial evidence, a land rights certificate in the name of the respondent. The judge finally gave a verdict which stated that the respondent was guilty by the legal consideration of written evidence in the Court and the witness testimonies which stated that plaintiff was the person who had the right for the land, while the respondent’s land rights had no legal enforcement and legally null and void. Therefore , it was necessary to study the enforcement of legal certainty in land ownership on the Landraad Verdict and the legality when a person had the evidence of land rights certificate. Abstract

Cooperation agreement between PT Bank X (Persero) Tbk and PT. Kelola Jasa Artha devoted to operational ATM section aims to conduct replenishment or distribution of funds collected from the public can be used by the customer, in providing efficient service and quick to serve the customer the bank requires the other party to be able to provide the best and quick service for customers and also reduce the operational costs of distributing money to the cash machine to enhance the needs of modern society and the well-being of human life in general. The use of ATM in general does not always bring positive impact to the customer. In using ATM customer also often get problems that ultimately harm the customer. Customer complaints is a very valuable source of information for the evaluation of the improved performance of the company, whether its human resources as well as its products. Abstract

The principle ofpacta sunt servanda is a principle which is found in law of obligations which means that when a contract is signed by both parties, they have to comply with the content of the contract. The research used judicial normative and descriptive analytic. The legal consequences of the principle of pacta sunt servanda in breaching the contract by Bank Mandiri, Citra Garden Sub-Branch, Medan, is that it will get the sanction of legal remedy from the other party that it has to fulfill its performance. The correlation between the principle of facia sunt servanda and the principle of good faith in KTA contract in Bank Mandiri, Citra Garden Sub-Branch, Medan, is that the principle of facia sunt servanda becomes the supporting principle for the implementation of the principle of good faith in which the former will provide legal certainty that the contract has been signed with good faith. Abstract

As a country with unlimited mineral and coal, Indonesia need Government’s role as ruler for these resourches in an effort to regulate their use optimalisasi revenues for it’s people prosperity. PT Sorikmas Mining (SMM) is one of company that use Work Contract there in regarding the company’s capital investment with The govermnet’s shareholding inthe field of Work  Contract VII Generation. This research is descriptive analytic research that describe, explain and analyze the determination of government shareholdings in foreign companies in the mining sector with normative juridical method, which refers to the legal norms contained in the legislation, and with regard to principles and norms in foreign investment The result of this analysis show that as a company who invest in Indonesia, PT SMM also imposed the obligation to divest its stake,in accordance with the Government Regulation No.24 Tahun 2012 abaut Mining, Mineral and Coal. The implementation of the mining activities carried out by PT Sorikmas Mining will be monitored well by the Government directly from the company if the government became part of the shareholders so that they can do governance oversight function of mining companies.   Keywords:  Foreign Investment, Divestment Share, Contract of Work

Abstract

It is totally true that the credit given by the banks has risks. Therefore a bank must concern with the principles for resposible lending. To reduce those risks, a bank should convince themselves that the debtor is able to pay its obligations in accordance with the agreement. It is an important factor that must be considered by the bank. So, before giving a credit, banks should do some assessments of the character, capability, collateral and business prospects of the debtor. If those elements have been able to convince the lender, a bank just asks the principal guarantee, without any additional guarantee from the debtor like valuable papers in which the inherent right charged, such as shares, stocks, the decree of civil servants (SK PNS) or the decree of pension, and other documents. Although SK PNS is not a transferable object (which has the value of the redirects), but in the developments of the banking practice, some banks accept it as credit guarantee because it has economical value. The problems discussed in this research were what the position of SK PNS as  guarantee credit when it becomes the legal basis of banking credit was, what the legal consequences and accountability of civil servants over the collateralized SK PNS in credit agreements if the civil servants was fired was, and what the role of insurance companies in solving problems of credit insurance claims which the collareal was only SK PNS was.To answer those problems, this reasearch uses descriptive analytical method which intented to get the detailed description sistematically about this research’ problems. Abstract

People are usually interested in selling goods through auction because an auction can give some benefits and goodness, compared with the other systems in giving legal certainty. The implementation of auction in Batam is generally done by KPKNL which usually performs auction which is bound with fiduciary collateral or hypothecation. Regulation on auction guarantees legal certainty but does not always give legal protection to the winner of foreclosure sale as it can be seen in the case of auction done by KPKNL in Batam: the auction of other people’s goods. The problem of auction is general about the complaint from the third party so that the winner becomes a defendant. Therefore, bidders should be careful in buying other people’s goods in foreclosure sale and legal protection should be available for winners which are claimed by the third party. Bidders’ good faith in fulfilling their responsibility in the auction process is very vital in getting legal protection when they become the winners, and the implementation is realized by the issuance of auction letter as legal certainty for owning the goods. Auction letter is a kind of preventive legal protection for winners; therefore, when it is cancelled by court’s verdict which causes harm and when there is a claim for winners, they actually have the right to get repressive legal protection and responsibility from stakeholders, either from the goods sale or from KPKNL.   Keywords:       Legal Protection, Auction Winner, Goods complained by the Third Party

Abstract

A notary as a public official is required to comply not only with legal provision, but also with his professional ethics because without it his professional dignity will be no use. Based on the Ruling of Medan District Court 467/PDT.G/2010/PN.MDN between Mr. HS (capital owner, plaintiff) and Mr. DL (defendant, contractor), beginning with cooperative agreement: Mr. HS and Mr. DL bought a plot of land from Mr. X in which the trade was done before a notary based on a purchase contract and Power of Attorney, Mr. DL (defendant I, Contractor) as the buyer, but all costs of buying the land were paid by Mr. HS (plaintiff, Capital owner). The problem of this research were as follows: the responsibility of the parties concerned in the case of underhanded purchased contract, legal force of the legalized underhanded purchase contract, and the responsibility of the notary/PPAT (Official Empowered to Draw Up Land Deeds) to keep the original certificate safe in the certificate distributions. Abstract

The implementation of the clause on house renovation restriction in housing purchase agreement that are made by developer using standard contracts is that they have to firstly prepare the agreement in written form as well as for the clause of the article in housing purchase agreement. This objective of the study was to determine the rights and obligations of the developer, PT. BRC (Limited Liability Company of Bangun Riau Cendikia), toward PT. BRC consumers as the buyers who had lived in Vila Cendikia Cluster. This study entitled Protection for Consumers in the Inclusion of Clause on House Renovation Restriction in Housing Purchase Agreement at PT. Bangun Riau Cendikia (PT. BRC) in Pekanbaru. It was an empirical judicial research.  It took 15 (fifteen) respondents representing the property buyers and residents. The results showed that the rights of property buyers were found to be imbalanced with the rights of PT. BRC developers due to the restriction resulted from the inclusion of clause on house renovation restriction stated in the PPJB (Housing Purchase Agreement) whereas reviewed from the Laws No. 8/ 1999 on Consumers Protection Article 1(8) Clause (1), the inclusion of standard clause is strictly prohibited for any businessmen who offered their products. Meanwhile, the inclusion of the clause on house renovation restriction harmed the consumers’ freedom to make renovations which have become more limited; the consumers had to get an approval from the developers of PT.
