Abstract

A foreign citizens cannot be ignored to be an heir as stipulated in Article 26, paragraph 3, Article 30 paragraph 2, and Article 36 paragraph 2 of UUPA the legal consequence of violating it is that the ownership will be cancelled. The result of the Case of the Supreme Court’s Ruling No. 1134 K/Pdt/2009 research shows that the procedure if signing a  will before a Notary for a foreign citizen in making a certificate should pay attention to the spa of time of the land rights by checking the identity of the foreign citizen and the other supporting documents. The list of data at the Sub-directorate of Estate in the Ministry of Law and Human Rights by giving the copy of the Will which has been made in Indonesia. The legal status of the Ownership certificate registered in the name of the defendant is recognized as the defendant’s since the land has been registered sporadically and transparent in the name of the defendant, based on the will and the man empowered to receive the will. It is also approved be the authorities such as Subdistrict Head, the National Land Board, and witnessed by the neighbors. Besides that, the defendant has changed his citizenship before the certificate is issued. The judge’s consideration in the Supreme Court’s Ruling No. 1134 K/Pdt/2009 does not give legal certainty in the administrative process of issuing the certificate. Abstract

Nominee structure is a structure resulting in a beneficiary has the power to controls the nominee, where a nominee is only as a registered owner of an object, and the beneficiary as the real owner is the one who controls, manages and earns benefits from that object. Nominee structure is often applied in the ownership of shares in a limited liability company in Indonesia. The data for this normative juridical study were obtained through documentation study in which the data obtained were systematically arranged and analyzed through a qualitative scientific logic procedure. The form of nominee shareholder structure in Indonesia is divided into direct nominee structure and indirect nominee structure. Basically the validity of a nominee shareholder structure is depends on the validity of the underlying agreement. A public notary as the competent authority who creates an authentic deed as the underlying of a nominee structure is responsible to make sure that the deed he made must comply to and does not breach the prevailing laws and regulations. It is suggested that a clear and strict regulations about the nominee shareholders should be governed in the Company Law in order to create legal certainty. Nominee shareholder structure should be allowed with special supervision and certain restrictions, considering the using of a nominee is basically indispensable in order to transact effectively and efficiently, particularly in capital markets. Abstract

A notary is a public official appointed by the Government; in this case, the Minister of Justice and Human Rights of Republic of Indonesia, who has a function to provide a service to the society and an authority to make an authentic deed in almost all legal actions as referred to the laws. This is a normative judicial research with prescriptive analysis which approaches the research problems by reviewing the prevailing legal provisions in the Notarial Law stipulated in UUJNNo. 30/2004 (the Law on Position of Notary) juncto UUJNNo. 2/2014. The results show that he has to make an authentic deed in line with the prevailing legal provisions in the Notarial Law as stipulated in the UUJN No. 30/2004 juncto the UUJNNo. 2/2014 and Article 1868 of Civil Code regarding the Procedure of the Making of Authentic Deed for Public Official. Notary whose tenure has ended is still responsible for the deeds he has made until he passes away because there is no regulation in the prevailing provisions that obviously states the time limit of the responsibility of a Notary for the deed he has made. He is also responsible for the making of the authentic deed concerning the names of the persons appearing and the accuracy of the date of the deed. Abstract

In its development nowadays, land becomes the most common problem, particularly about the overlapping certificates. In general, the problem about this overlapping certificate occurred in a tract of land which has double certificates and the owner of the land want to or has done legal action on the land. For example, a land certificate is used as collateral in a Bank, but execution cannot be accomplished because there is another person who has the certificate on the land. Therefore, the researcher wanted to find out what factors which caused the incident of overlapping certificates and how about the legal protection for the Bank as the creditor. The result of the research shows that the factor which causes the incident of overlapping certificate is administrative error (internal factor) done by some employees intentionally for their own interest in the Land Office, while the external factor of the Land Office is the bad intention of the person who requests his right for registering the certificate, Therefore, the management of the Land Office as the institution which issues land rights certificates is not responsible for the existence of overlapping certificate although they are always ready to be the mediator in resolving the dispute about overlapping certificate by doing the study on physical and judicial data. The Bank, as the creditor for this problematic collateral, does not get any legal protection because there is no regulation in the legal provisions although the creditor can file the claim to the debtor, since the latter has violated the law, by asking for compensation from the debtor when the judge gives the verdict that the land belongs to the third party. Abstract

One of the interesting things in Marriage law is about marriage cancellation. Based on Article 22 of Marriage Law, it is said that if a marriage does not meet marriage requirements, it can be cancelled. It is possible for a marriage, which is religiously valid but does not follow the rules and laws, according to Article 22 of Marriage Law, to be cancelled.The research used descriptive analytic and judicial normative method. The conclusions of the research were as follows: Islam highly emphasizes on the requirement for the same religion in wedlock because the purpose of marriage in Islam is  a marriage is not solely related to muamalah (relationship among human beings), the judge’s consideration at the Medan Religious Court in his Verdict No 569/Pdt.G/2008/PA.Mdn states that marriage cancellation due to a divorce is not a cancellation and legal consequence of marriage cancellation on the relationship between husband and wife is considered void, the child’s right is not retroactive, and property for the husband and wife who have good faith, except joint property. It is recommended that a marriage couple participate in pre-marriage   counseling and judges prioritize the Islamic personality principle. Abstract

Certificate of Heir for native citizens is usually made by the heirs themselves, signed by Village Head, and acknowledged by Subdistrict Head. Besides that, it can also be directly made by Village Head and acknowledged by Subdistrict Head; it contains the names of heirs who have the right to inherit the property. The research used judicial normative and descriptive analytic method. The result of the research shows that Certificate of Heir which is made by the heirs, signed by Village Head, and acknowledged by Subdistrict Head. A Notary is not responsible for a sales contract which uses Certificate of Heir issued by Village Head, and thus it is considered invalid. A Notary is only responsible for the authenticity of a Sales Contract drawn up by him since it is in line with the prevailing legal provisions on Notarial Position as stipulated in UUJN (Notarial Act) No. 30/2004 juncto UUJNNo. 2/2014.   Keywords: Certificate of Heir, Village Head, Notary, Native Citizens

Abstract

Cooperative is a business entity which has individuals or cooperative legal entity as its members and its activities are based on cooperative principle and its people-based economic movement which is based on the principle of consanguinity. The deprivation of Law No. 17/2002 on Cooperative by the Constitutional Court is because it is regarded as being contrary to the general principle of cooperative. The research used judicial normative and descriptive analytical methods by analyzing. After the issuance of administrative regulation of Law No. 25/1992 on Cooperative in 2004, the Regulation of the Minister of Cooperative, and UKM (Small and Medium Enterprises) No. 01/Per/M.KUKM-I/2006 on Operational Manual and the issuance of Law No. 17/2012 on the new Cooperative, the role of a Notary becomes important because cooperative memorandum of association has to be made by using notarial authentic deed which is validated and registered in the Ministry of Cooperative and UKM and because the Constitutional Court temporarily waits for the issuance of the new Law on Cooperative by the Parliament. Abstract

PT. Perkebunan Nusantara III (Persero) has to perform land acquisition in the area of 2,002.77 hectares at Sei Manmgke Village, Bosar Maligas Subdistrict, Simalungun District, which would be Specific Economy Area. Since the Leasehold is still attached to the land, PT. Perkebunan Nusantara III (Persero) amended the Leasehold to the Right to Manage in condition that the company filed the permit of Leasehold to the Land Office of North Sumatera. The result of the research showed that, the company filed a survey on the Leasehold area in the area of 2,002.77 hectares to the Land Office of North Sumatera. After the renunciation of rights was approved, the request of the Right to Manage was filed to the National Land Board of the Republic of Indonesia. The result was that the Head of the National Land Board of the Republic of Indonesia issued the Decree No. 27/HPL/BPN RI/2014 on the Approval of Giving the Right to Manage on the name of PT. Perkebunan Nusantara III (Persero), located in Medan for 4 (four) tracts of land, located in Simalungun District, North Sumatera on June 23, 2014. The changing process from the Leasehold to the Right to Manage in the Specific Economy Area Sei Mangke was constrained since the Layout of Simalungun District was not completed so that the Specific Economy Area did not have the layout, the constraint of the term of the change of the right, and internal and external constraint in that area. Abstract

A dispute over land rights commonly occurs in society. It  has occurred in Helvetia Village, Labuhan Deli Sub-District, Deli Serdang District based on the Supreme Court’s Ruling No.537.K/Pdt/2011.The problems of research were whether or not the renunciation of rights and the compensation for tilled land were legitimate based on the judge’s consideration and the legal consequence for the tilled land ownership; and, how about the settlement for the tilled land dispute based on the Supreme Court’s Ruling No. 537.K/Pdt/2011 which had given a legal certainty to the owner. This research applied descriptive analysis design which was aimed to provide a systematical, factual, and accurate description. A descriptive analytical research describes, reviews, explains, and analyzes laws both theoretically and practically in the research results. Keywords: Dispute, Ownership, Tilled Land
