Abstract

There were some problems of appointing an illegitimate child as an heir : First, not all testaments contain the appointment of an heir for an illegitimate child; therefore, a Notary is needed in the process of drawing up the testament which is called a erfstelling testament. Secondly, in inhering an inheritance, an illegitimate child does not automatically inherit; it depends on the amount of share through testament (will) by his parents. Thirdly, there are some process which will be done in appointing  an illegitimate child. The process of implementing a testament for an illegitimate child should fulfill the requirements of the testament, the completion of all documents, and inheritance certificate from his father (testator). Abstract

Insurance business has long existed in the Indonesian economy and participated in the national history, along with the other economic activities. However, it does not guarantee that it runs smoothly. Legal problem like default case of default in the fire insurance between PT. Pupuk Subur Makmur and PT. Asuransi Wahana Tata. The conclusion of the research was that PT. Pupuk Subur Makmur had been inattentive in carrying out its obligation by declaring default to PT. Pupuk Subur Makmur. In consequence, it had to be fined as it was decided by the Panel of Judges of the Supreme Court No. 911K/Pdt/ 2009. It is recommended that both parties have sense of justice in carrying out their right and obligation in the insurance contract, they have to be honest in order to avoid dispute in making an insurance contract between the guarantor and the insured. Abstract

A will is a statement made by someone on what they wish after they die. Frequently, a will maker does not inform his heir(s) to the will receiver. The condition when the heir(s) receiver does not know about it creates uncertainty on who should be responsible for the absence of information about the will. The problems of this research were what role a will, which was not known by the heirs or the will receiver, had for the natives; what legal consequences in the future a will was found. The will which was not known by the heirs and will receiver remained voidable and provable as long as it had been made in accordance with the formality of making will; however, the absence of information about the existence of this will made it unable to be implemented by the heirs and the will receiver who were natives. Abstract

The implementation of distributing inheritance in the Chinese of the Indonesian citizens is based on the Civil Code since there is no law which regulates it. The implementation of distributing inheritance in the Chinese community in Gunungsitoli, Nias is based on the Chinese adat law by discussing the share of each heir in a spirit of mutual cooperation and consensus. The legal consequence of this system is that it is binding for the heirs to comply with it. It becomes the basic philosophy for settling any conflict about the distribution of inheritance so that it is the least possibility for the heirs not to agree with this amicable decision because of the strong adat tradition among the Chinese community, and the adat law practitipners themselves have admitted its existence. Abstract

In the practice of corporation, a lot of nominee practices can be found in the organs of limited liability companies. Nominee Commissioner is used by the real owner of the company (beneficiary) in order to control the company freely—especially to the extent of the approval award for the Board of Directors’ (which might be Nominee Director as well) actions that need the approval from the Board of Commissioners—which is misused for committing crimes only for the sake of profit earning. This research is the research which uses the normative juridical or doctrinal legal study. The conclusions drawn from the result of this study are: the appointment of Nominee Commissioner is undertaken so that the real company owner (beneficiary) will be able to control the company freely without any concern of his/her name being appeared in the company documents dan could evade from legal liability if the Nominee Commissioner as the supervisory organ of the company did not  perform his/her duties and obligations which resulted in the charges of legal sanctions; a Nominee Commissioner—given the reality that he/she is a mere fictitious commissioner organ who does not have any authorisation over the company—can always be charged of criminal liability towards the criminality (-ies) of the company by taking into the consideration of the mistake element inside himself/herself; and the charging of criminal liability towards both corporation and Nominee Commissioner altogether can only be carried out if the provisions have been regulated under certain prevailing laws.   Keywords: Nominee Commssioner, Criminal Liability, Limited Liability Company

Abstract

An auction sale is a legal document report from the process of auction execution arranged based on the Ministry of finance Decree No. 106/PMK.06/2013 about the changes of the Ministry Finance Decree No. 93/PMK.06/2010 about the changes of auction execution. One of the characteristics auction sale certificate is made by the an auction official appointed by the Minister authorized to lead the auction process. The research is related to a notary as a public official who can undertake dual positions as an auction official of class II. The problems of the research are how the legal regulation of a notary’s authority is an Auction of official Class II to lead the Auction process, and how the legal power of the Auction certificate is to prove made by the Notary as the Auction Official Class II in civil case. Abstract

A contract on the acquisition of land with buildings on it is made underhandedly, this kind of contract is basically unrecognized in the Indonesian agrarian system and in the Civil Code. The research used descriptive analytic and judicial normative method. The conclusions of the research were as follows: a contract on the acquisition of land for constructing buildings on it is a standard contract, the responsibility which will be taken by the buyer when he is default is fine and time limit, while the seller is responsible for limitation, and the acquisition of land with buildings on it only has legal force of material evidence. It is recommended that the parties concerned pay specific attention to the right buying and selling of land, it should be signed by a Subdistrict head and village heads, and  should be a firm regulation and controllers on standard contracts which have specific clauses. Abstract

Hibah is giving an object to another person who is still alive voluntarily without expecting any reward. KHI gives the limitation of hibah for only 1/3 of the property. The legal consequence of hibah which exceeds the provision in the Islamic fiqh and in KHI is considered illegal and can be cancelled by the Religious Court if any of the other heirs file a complaint. Judge’s consideration on the cancellation of hibah No. 616/Pdt.G/2010/PA-Mdn is first, hadist of the Prophet Muhammad, ”parents can get back what is given [to their children].” Secondly, hibah which is more than 1/3 of the property is illegal. Thirdly, the receiver of hibah breaches the agreement given by his parents. Fourthly, the receiver of hibah cannot prove the sales agreement, except only hibah certificate. Abstract

Concept of adoption is of unknown origin according to the perspective of the Islamic Fiqh, basically there was never any concept of adoption as set out in the Child Protection Act and Government Regulation of Adoption, Islamic Fiqh justify Hadhanah (childcare) Istilhaq concept, while according to the perspective of the Child Protection Act and KHI and Government Regulation No. 54 of 2007 on the Implementation of Child Adoption, prospective adoptive parents apply for adoption who have met the requirements to court to obtain a court warrant. Adoption should be confirmed by a court decision. Equation concept of adoption according to Islamic jurisprudence is positive law requires the same religion for parents and adopted children, considers that the adoption can not decide on a blood relationship between the adopted child with his biological parents, and also require the adoptive parents not to hide the identity of biological parents of the child. While the difference lies in the position of adopted children, about the manner of adoption, and of inheritance, the adoption of Islamic law does not give rise to inherit inheritance relationship between them is in the positive law explained that the adopted child is entitled to inheritance. Abstract

The problem of land ownership status in adat settlement in Aceh has existed since the issuance of the Decree of the minister of Forestry and Plantation No.170/Kpts-II/2000 on June 19, 2000 which established forest and territorial waters of around 3,549,813 hectares. After the issuance of the Constitutional Court's Ruling No. 45/PUU-IX/2011 and 35/PUU-X/2012, all forest areas in Aceh as stipulated in the Decree of the Minister of Forestry has been declared void and, land ownership in adat settlement which used to be the State’s forest area has gotten its legal status. Land acquisition and ownership in adat settlement of forest area, according to the community at Alur Keujrun, South Aceh District, was a legal basis for land acquisition, based on border line right. Some measures which should be taken by them to get legal certainty on the land right is, principally, by controlling the land until they get recommendation letter from the village head which confirms that the requesting for the land right has been submitted to the Head of the Land Office. Some obstacles in getting legal certainty on the status of the land ownership in adat settlement of the State's forest area consist of inconsistency in the existence of land acquisition by the adat law community and communal right of disposal, non-synchronizing of legal provisions, and non- compliance with general principles and legal provisions.   Keywords: Land Acquisition, Adat Forest, Adat Settlement
