Focus and Scope AL-ASHLAH : Jurnal Hukum Keluarga dan Hukum Islam is a double-blind peer-reviewed journal published by Islamic Family Law Department, Sharia Faculty, Institut Agama Islam (IAI) Ibrahimy Genteng Banyuwangi, Indonesia. Focus AL-ASHLAH : Jurnal Hukum Keluarga dan Hukum Islam emphasizes the study of Islamic family law and Islamic law in Islamic countries in general and specifically in Indonesia by emphasizing the theories of Islamic family law and Islamic law and its practices in the Islamic worlds that developed in attendance through publications of articles and book reviews. Abstract

Child marriages that have a negative impact must be prevented through preventive measures. In order for the prevention efforts to be carried out properly, efforts must be made by all elements. Child marriage will be discussed using a qualitative method based on library research. Thus, this research results in efforts to prevent child marriage and so that it can be understood and implemented by readers.

Abstract

Penelitian ini dilatarbelakangi oleh permasalahan yang ada pada periklanan di media sosial Instagram. Akan tetapi tidak sedikit pelaku usaha menampilkan produk yang tidak sesuai dengan fakta dan tidak jarang pula mengabaikan norma-norma serta nilai-nilai kejujuran. Penelitian ini menggunakan jenis penelitian kualitatif yang bersifat field research dengan pendekatan deskriptif. Hasil dari penelitian ini yaitu: 1) Etika bisnis yang baik dalam periklanan di media sosial instagram harus sesuai dengan aturan hukum yang ada. Kejujuran merupakan salah satu prinsip etika bisnis dalam periklanan, karena masih ditemukan pelaku usaha online shop yang tidak jujur dalam mengiklankan produknya di media sosial instagram. 2) Hukum ekonomi syariah memperbolehkan periklanan di instagram jika periklanan tersebut sesuai dengan prinsip etika bisnis Islam. Etika bisnis Islam mengajarkan bagi pelaku bisnis untuk selalu berlaku jujur, tidak membohongi konsumen dengan berbagai tipuan. Etika bisnis Islam harus memperhatiakan prinsip-prinsip keadilan, kesatuan, pertanggungjawaban, kehendak bebas, kebajikan dan kebenaran.

Abstract

Marriage in Islam is not solely a relationship between husband and wife, but more than that Islam views marriage as an act of worship value because every action that each spouse performs when fulfilling his rights and obligations in marriage is an act of good and bad value. Rights and obligations in the household that do not work as stipulated in Islam are known as nusyuz. The problem of nusyuz in Indonesia has always been associated with the wife, as well as in the legal arrangements, namely in the Compilation of Islamic Law (KHI) only regulates the nusyuz of the wife. Nusyuz that occurs in the household can come from the side of the wife or the side of the husband. According to Soerjono Soekanto, whether or not law enforcement is effective in society is determined by several factors, namely law enforcement, legal facilities, legal awareness, legal rules, and legal culture. The law on domestic violence enacted through the law has not been fully enforced effectively to provide protection for victims of domestic violence.

Abstract

This study aims to determine the role of waqf in improving community welfare and the development of educational institutions in Darussalam Blokagung Banyuwangi Islamic boarding school. Waqf in Islam is one of the economic instruments for many social institutions, especially in the field of education. The problem raised about the role of waqf in the welfare of society and the development of education, this study uses a qualitative descriptive approach, where the results of the research show that waqf at the Darussalam Blokagung Islamic boarding school has been optimally managed for community empowerment. One of the strategic functions of the results of existing waqf assets is to alleviate poverty, unemployment, and community resilience through education and empowerment. Thus, the existence of this education-based waqf can indirectly improve the welfare of the community in the aspects of internalization and character building (Character Building) for students and santri so that they become knowledgeable, mature, independent and productive people. Abstract

Pernikahan beda agama masih menjadi polemik hingga saat ini. Tidak dapat dipungkiri, di zaman yang segalanya terbuka, perjumpaan insan beda agama tidak dapat dielakkan. Dalam konteks hukum Islam, pernikahan beda agama juga masih menjadi kontroversi. Masing-masing pendapat hukum disertai pertimbangan (konsideran). Masing-masing pihak yang melegalkan maupun tidak mengemukakan kemaslahatan sebagai pertimbangan dalam menetapkan hukum. Di satu pihak, pernikahan beda agama dilarang karena dapat menimbulkan mafsadat, yaitu dapat menyeret muslim menjadi non muslim. Di pihak lain, pernikahan beda agama dibolehkan karena dapat menyeret non muslim menjadi muslim. perdebatan ini perlu didudukkan dalam kerangka Fiqh al-Maqasid. Hal ini dapat merupakan upaya untuk memosisikan hukum Islam pada porosnya (inathat al-ahkam al-syar’iyyah bi maqasidiha)
