Abstract

The judge's decision is the final decision taken by the judge in the trial to determine whether the defendant will be sentenced or not. This decision is an official statement from the judge in resolving a case in court and has permanent legal force. This decision serves as a legal basis that determines the rights, obligations, or sanctions that must be carried out by the parties involved in the case. Independent judicial power is used to uphold law and justice. In Decision Number 26/Pid.Sus.Anak/2021/PNSak, the child was ordered by his biological brother to store methamphetamine. This research is conducted to examine and analyze whether the judge has considered the sociological factors of the defendant and analyze how the influence of the judge's consideration of the defendant's sociological factors on the imposition of punishment in Decision Number 26/Pid.Sus.Anak/2021/PNSak. This research is useful for reviewing and analyzing legal norms, as well as the judge's decision using normative legal research. The approaches used include statute approach, case approach and concept approach. This analysis also uses prescriptive. The results of this study are the Decision of the Judge of the Siak Indrapura District Court in case Number 26/Pid.Sus.Anak/2021/PNSak, which has fulfilled the juridical elements but the judge did not pay enough attention to the sociological aspects of the defendant because it did not cover the defendant's condition at that time. The child followed his brother's orders to store methamphetamine due to threats from him.

Abstract

Menjadi seorang Pekerja Migran Indonesia memiliki berbagai macam tahapan prosedur yang harus dilalui. Dalam proses tahapan pengiriman PMI ke negara tujuan mereka, masih banyak terjadi penyalahgunaan prosedur dari para oknum yang membuka jasa layanan untuk bekerja di luar negeri. Meskipun terdapat aturan yang menjamin hak-hak PMI ketika bekerja di luar negeri, ternyata masih terdapat kasus dimana hak-hak Pekerja Migran Indonesia tidak terpenuhi Undang-Undang Nomor 18 Tahun 2017 yang merupakan penguatan dari peraturan sebelumnya, Undang-Undang Nomor 39 Tahun 2004 Tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri juga belum memberikan perlindungan secara total kepada Pekerja Migran Indonesia. Banyaknya keinginan masyarakat untuk bekerja dengan prosedur yang lebih mudah dan cepat mengakibatkan banyak calon PMI memilih untuk mengambil jalur pendaftaran melalui Maid Online Sytem milik Malaysia yang merupakan sebuah sistem perekrutan dengan bentuk pengoperasiannya dengan cara mengakses database pekerja potensial melalui platform online yang disediakan oleh pemerintah. Database ini berisi profil dan informasi tentang pekerja migran yang tersedia, termasuk pekerja rumah tangga dari berbagai negara, hanya saja sistem ini bertabrakan dengan peraturan yang diberlakukan di Indonesia. Tujuan dari penelitian ini untuk mengetahui lebih jelas mengenai keabsahan dari jalur perekrutan direct hiring dengan Maid Online System pada PMI sektor domestik di Malaysia, serta untuk mengetahui bagaimana seharusnya penyelesaian tentang perekrutan PMI agar sesuai dengan peraturan yang berlaku sehingga meminimalisir para pekerja migran diperlakukan tidak adil oleh majikan. Penulisan ini menitik beratkan pada penelitian pustaka berupa pengumpulan bahan hukum dengan pendekatan perundangan dan konsep yang dianalisis secara perspektif hukum.
