Abstract

Tulisan ini menganalisa apakah ada persamaan antara hukum internasional yang bersumber dari Barat dan hukum Islam (Syariah) yang banyak diterapkan di negara-negara dengan mayoritas penduduk beragama Islam antara lain Negara-negara di Timur Tengah, sebagian Afrika (NegaranegaraMagribi), dan sebagian negara di Asia Tenggara antara lain Indonesia, Malaysia dan Brunei Darussalam. Hukum internasional dan Hukum Islam (Shari’a) memiliki persamaan mendasar dalam hal hak asasi manusia terutama jika dikaitkan dengan perlakuan yang sama apapun jenis kelaminnya. Tulisan ini mencoba menganalisa persamaan antara hukum internasional dan hukum Islam terkait hak-hak perempuan dalam pernikahan. Propinsi Aceh, Propinsi Sulawesi Selatan dan Propinsi Jawa Barat adalah 3 (tiga) propinsi di Indonesia yang menjadi studi kasus dari tulisan ini. Abstract

ASEAN Community 2015 became one of its own products made by ASEAN leaders to ease the creation of a variety of access both in the economic, political, social, cultural, defense and security. Within the ASEAN Community 2015, becoming one of its own steps to open markets more freely so that the movement of the mobility of goods and services can be channeled properly not only in the country in each of the ASEAN countries, however, can be transferred to all other countries. One of the constraints in this regard is how the readiness of the government of a country in ASEAN to face of fierce competition that will take place freely and openly among various countries so that if not handled properly can result in a fairly high unemployment because the foreign labor which is presented in one of the ASEAN countries is a labor that has a high skill. Therefore, the government must also concern related to the brain circulation phenomenon are able to strengthen the various sectors where the government is able to provide its own facilitieswith the provision of the allocation of funds for research and development and create policies that ensure the products to the convenience of skilled labor to carry out research in homeland then it will strengthen the stability of labor market in ASEAN. Abstract

Regarding the significance of Malacca Strait as a key maritime’s “choke-point” passage betweenIndian and Pacific oceans, some major countries become dependence with the security and safetyin Malacca Sea Lines of Communications (SLOC). China and India are two states-user ofMalacca Strait which sharing common interests of economic, maritime trade and energy supplies.The problem is, as a regional power of each region, India and China have an ambition to controlthe security of Malacca’s Strait. China which is more dependent with its 80% trade and energysupply through Malacca Strait, facing “Malacca dilemma” regarding the issue. Then, with thestrategy of “string of pearls” and the modernization of of People’s Liberation Army Navy (PLAN),China became assertive to save its interests. India, which has control over Indian Ocean then feelthreaten by China’s activities around Malacca Strait and Indian Ocean. India starts and enhancesthe development of Andaman Nicobar Command with US support near Malacca Straits to counterChina’s development. This paper will analyze the development of China’s dan India’s maritimestrategy rivalry in Malacca Straits with the concepts of balance of power and maritime strategy. Abstract

Konflik di Thailand Selatan antara pemerintah Thailand dan kelompok muslim Pattani menjadi satu gambaran konflik berkepanjangan ketika tidak adanya pihak ketiga yang menjadi mediator dalam konflik ini. Jika dilihat dari durasinya, tuduhan satu dengan lainnya pada pihak yang berkonflik dan kematangan dari konflik itu sendiri maka, konflik Thailand Selatan sudah dapat dikategorikan sebagai intractability conflict. Kondisi konflik Thailand Selatan menjadi potret ketidakmaksimalan negosiasi yang dilakukan oleh kedua belah pihak berkonflik tanpa ada pihak ketiga yang menjadi mediator. Tulisan ini menawarkan strategi lain yang dapat dipergunakan dalam penyelesaian konflik dengan melibatkan pihak ketiga.
