Abstract

The case of this thesis is how the regulation of judicial local act authority in Indonesia. And how the implementation of  185 articel of act number 32/2004 about the local government. And what the implication of 144 article of act number 32/2004 about the local government and what the law instrument is appropriate with province act strike down. From the conceptual approach and statute approach, we can make conclusion that the judicial of local act could be done from two authority, judicial review with supreme court and executive review with president c.q the internal minister, the stating of local act in 185 article of act 32/2004, can’t to implementing, until the mixtime a long 30 days to stating the local act is not impelemented. And the executive regulation as the instrument to strike down the local act is wrong. Because of that, recommended to make harmonization or synchronization between executive and Supreme Court sincronisation  authority. And revise 185 article of act 32/2004  and the law instrument to strike down a province act is president decition.

Abstract

Comparison of Law in domestic violence between Indonesias with Singapore, has equality from second region culture of this state resides in South-East Asia, also is including country ASEAN, but also has difference from Luas Wilayah Singapura consisted of one main islands and around 60 isles with wide total 682,7 kilometre persegiTerletak between peninsulas Malayasia and Indonesia dissociated by strait Johor and Selat Singapura. Number Of Indonesia Residents is including the biggest in world after Chinese and India. Agreement of Member State ASEAN for  ASEAN Charter as kontitusi ASEAN at Konf ( KTT) to 13 in Singapore November the year 2007. ASEAN as subject law ( has legal of personality.)

Abstract

The pilot of the aircraft had the role that was very important in the flight, especially to guarantee the security and the safety of the flight. Therefore, the pilot must know about his authority as the pilot. The authority of this pilot related to the competence certificate and the licence. Giving of the competence certificate and the licence  to the pilot of the aircraft must meet certain conditions and was given by certain sides. Legally, the competence certificate and this licence were arranged in several instruments of the national air law and the Internasional  air Law. The instrument of this law in part of regulations number 1 in 2009 about the Flight, Chicago  convention1944 about  the Internasional Civil Aviation, Annex 1 of the Personnel Licensing and Part 20 Civil Aviation Safety Regulation. The role of the pilot as the aircraft guide(the pilot technically) have  relation to the role of the pilot  as the yuridically manner ( the commander of the aircraft). juridically the role of the pilot  related to his authority to take part in playing to  combatting crimes that were carried out in the aircraft that was flying. The authority of the pilot as the commander of the aircraft in arranged in the Tokyo Convention 1963.

Abstract

The Amanded of UUD 1945 changed basically the structure and State institutional. the change of  the structure State institutional that is, was formed several of the new State institutionals, among them the Yudisial Commission (KY), the Constitutional  Court (MK) and the Council of Representative of the Area (DPD). The UUD 1945 amanded unclear defined the State institutional, that is caused the inter-institutional authority dispute . Who right to  interpreted the State institutional and what institution  that were said as the State institution  according to UUD 1945 fourth amanded  . The Institution that the Right to interpreted UUD 1945 is  the Constitutional Court. The State institutional that were meant in UUD 1945 is Peoples Consultative Assembly, the Peoples Representative Council, DPD, President, The ministry  of the State , BPK, , DPRD, the Commission of general election  (KPU), the Yudisial Commission, , the central bank, Republic of Indonesia Army, Republic of Indonesia State Police, and the Council of  President consideration  . The constitutional court had the authority to settle of   the inter-institutional authority dispute of the country that his authority was given by UUD 1945.

Abstract

A correctional institution is concerned with improving the behavior of criminals, usually by punishing them. It has a very important role in the  effort to restore the prisoners into society. As part of the correctional institution program, coaching is designed to correct the behavior of criminals in order to prevent them from committing a crime again. More importantly, coaching is not intended to make them suffering, and to abandon their human rights. The aim of this article is to give a brief overview of the correctional institution criminal system  in Penitentiary Class IIB of Tuban District under Law No.12 of 1995 on Penitentiary . In general, there are two approaches in conducting  coaching pattern  used by this Correctional Institution, namely by providing general coaching such as religious teaching, civic duties, intellectual capacity building and the raising of legal awareness. The Institution  also provides technical coaching  like  self-reliance building that is  realized by providing various skills that are tailored to the needs of the  prisoners. It should be pointed out, however, that these prisoner rights  are retained subject to  requirements set out in  the existing laws and  regulation. The author concludes that although the provisions of  Law No.12 of 1995 on Penitentiary are adequate to deal with the matters, Ministry of Justice and Human Rights should conduct a monitoring  task in the law enforcement .  Action can be taken to address the incompletenss of the current  legislation on penitentiary.

Abstract

Under the international human rights law, every state has the primary responsibility in the promotion and protection of human rights, that can not be reduced for political, economic and cultural reasons. Indonesia has enacted Law No 39 of 1999 on Human Rights and Law No. 26 of 2000 on Human Rights Court  consistent with the relevant  international human rights instruments. Under Article 71of Law No 39 of 1999 The Indonesian Government is obliged and responsible to respect, protect, enforce, and promote human rights as stipulated in this Law, other legislation, and the human rights international laws ratified by the Republic of Indonesia . In recent years, however, the gross violations of human rights have occurred in Indonesia, which have not yet been settled. The human rights are clearly violated by the Indonesia Authorities both civilian and military officials. This article is to study the legal  redress for the victims of human rights gross violations under the above national laws and Government Regulation No. 3 of 2002. The article will seek to demonstrate gaps in the current legal framework  governing human rights. The continuation of the impunity and injustice treatement  for the human rights victims is a direct result of the inadequate legislation.
