Abstract

AbstractThis research using juridical empiric approach and incorporated as evaluative-descriptive research by using analysis-qualitative methods. We are using primary and secondary source for our research source. We are using proficient and competent informant that work at PDAM and TSTJ. In order to choose our informant, we are using purposive sampling method. We also use interview and literature study in order to gather data for this research. As the conclusion we can assume that implementation of Corporate Social Responsibility of PDAM Surakarta basically already meet the Surakarta’s Local Government Regulation No. 1 Year 2004 regarding Amendment of Surakarta local government regulation No. 3 year 1977, Regulation No.5 year 1962, Regulation No, 32 year 2009. On the other hand, TSTJ Surakarta practically haven’t done Corporate Social Responsibility. Nevertheless, they have done the internal conservation by doing reforestation program in TSTJ Surakarta area. Revitalization of Local Government-Owned Corporation in Surakarta has been done in order to create Good Corporate Governances Awareness for the manager of the Local Government-Owned Corporation. Regulation No.5 year 1962 need to be revised by accommodating Corporate Social Responsibility and synchronized with regulation No.32 year 1934 regarding local governance.Keywords:Corporate Social responsibility, Local Government-Owned Corporation, Bengawan Solo’s WatershedAbstrakPenelitian ini menggunakan pendekatan yuridis empiris dan disusun sebagai suatu penelitian deskriptif-evaluatif dengan menggunakan metode analisis kualitatif. Sumber data yang digunakan baik sumber data primer maupun sekunder. Informan yang digunakan adalah informan yang layak dan kompeten dari PDAM dan TSTJ. Informan dipilih menggunakan teknik purposive sampling. Pengumpulan data menggunakan wawancara dan studi pustaka. Hasil penelitian menunjukkan bahwa implementasi Tanggungjawab Sosial Perusahaan (CSR) dari PDAM secara prinsip telah sesuai dengan Keputusan Pemerintah Kota Surakarta No. 1 Tahun 2004 tentang Perubahan atas Peraturan Daerah Kotamadya Tingkat II Surakarta No. 3 Tahun 1977, UU No. 5 tahun 1962 dan UU No.32 Tahun 2009. Di sisi lain, TSTJ secara spesifik belum melaksanakan (CSR). Namun, TSTJ telah melakukan konservasi internal antara lain dalam bentuk penanaman pohon di wilayah Perusahaan Daerah TSTJ. Revitalisasi BUMD Kota Surakarta harus dilakukan untuk mewujudkan pengelola yang menerapkan prinsip Good Corporate Governance. Undang-Undang Nomor 5 Tahun 1962 tentang Perusahaan Daerah perlu direvisi untuk mengakomodir peraturan tentang CSR yang disinkronkan dengan Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintah DaerahKata Kunci: Tanggung Jawab Sosial Perusahaan, Badan Usaha Milik Daerah, revitalisasi

Abstract

AbstractIt is empirical fact in Indonesia not only has written  law which imposed by state power ( state law). Beside written law there is also unwritten law  which often called the non state law. Political of law to  uniting as one political unity and enforce the legal sentralism has disregarded the  fact of legal pluralism ( the political of ignorance). Political of law  of the Judicial Power Code  which imposed during the time does not clearly arrange the state recognation to unwritten law, even unwritten law is recognnized, but still very sumir and floating. Although  Code No. 48/2009 about Judicial Power adopt the politics of legal pluralism and recognizes the existence unwritten law, but it is still sham (weak legal pluralism), causing that in fact predominate the state law still happened and unwritten law only becoming complement to state law. Political forwards legal pluralism in   Judicial Power Code ideally is not made conditional. The   political legal  pluralism of Judicial Power Code must to adopt strong legal pluralism,  so can accommodate pluralism in society.

Abstract

AbstractThis research aim to get the information on this materials, effort to descript the relation between each another. The study belongs to a normative law research using qualitative approach that is descriptive in nature. Some approaches used to analyse the issue is legislation, historical, and conseptual approaches. To solve the law issue and give prescription about the proper primary and secondary law materials that should be applied as investigating material with the technique of collecting the law materials study documents or literary reviews both printed and electronic (internet) sources are used. The choice for the election sistem is the legislation area, not a constitutionally norms. Its depend the legal politics, and there is not the reason when the pluralism sistem is more preference more than the district sistem. It related with the parliamentary recruitment, and the pluralism can more get the chance for the political party to fine their representative in the House. In order to get the ideal model in relation between party and the election sistem needs the consistence of the legal policy for formulating as public choice.Abstrak                    Penelitian ini bertjuan untuk mengetahui hubungan antara sistem pemilihan umum dengan sistem keparataian ditinjau dari asas negara hukum dan pilihan terhadap penetapan sistem pemilihan guna mencapai kebijakan penyederhanaan sistem kepartaian. Penelitian ini termasuk penelitian hukum normatif atau doktrinal dengan metode kualitatif. Sumber data penelitian bahan hukum primer dengan pendekatan perundang-undangan, historis, dan konsep. Analisis data bersifat kualitatif melalui proses reduksi dan penafsiran data serta penarikan kesimpulan. Hasil penelitian menunjukkan bahwa ditinjau dari asas negara hukum keterkaitan sistem pemilu dengan sistem kepartaian dapat diteropong dalam hubungan antara tiga elemen yaitu fungsi, sistem perwakilan dan legalisasi pemilu.Sebelum perubahan UUD 1945 dan sesudah perubahan UUD 1945 ada perubahan pelembagaan pemilu akan tetapi dalam tataran legislasi pemilihan sistem senantiasa tertuju kepada sistem proporsional dengan beraneka macam variasi dan perbedaan elemen-elemen teknis yang terkandung di dalamnya. Sistem proporsional dapat dilanjutkan sebagai kebijakan penetapan sistem pemilu yang cocok untuk Indonesia dengan enam catatan: (i) pengukuhan otonomi daerah dan peningkatan partisipasi lewat ketidakserentaan penyelenggaraan pemilu, (ii) pendisiplinan anggota DPR dan DPRD propinsi dan kota/kabupaten, (iii) restrukturisasi organisasi kepartaian, (iv) penciutan district magnitude, (v) konsistensi penerapan ambang (threshold), dan (vi) demokratisasi partai politik dalam tahap pencalonan. Implikasi dari penelitian adalah ada hubungan yang saling berpengaruh antara sistem pemilihan umum dan sistem kepartaian yang harus diperhatikan dalam kerangka penetapan sistem pemilihan umum. Sementara itu realitas praktis yang menunjukkan konsistensi penetapan sistem pemilihan umum proporsional harus diikuti dengan syarat-syarat tertentu agar dapat menjadi sistem penyederhanaan partai politik.
