Abstract

Critical Legal Studies (CLS) is an alternative thought in legal philosophy that can provide a different view of the law. The hallmark of this thinking is that it does not take the laws made by the state taken for granted before the process of critical reasoning struggles against its legal substance. There is a situation of distrust and concern that the laws made by the state cannot bring justice because the process goes through a tug-of-war struggle for political and economic interests, causing the legal product to be vulnerable to imperfections. Neutrality, and impartiality are the keywords that become indicators to purify the law. Therefore, CLS strives to always open the veil of power relations and economic relations which always interfere with the law with its own struggle and logic.

Abstract

The existence of rules limiting the cassation becomes an obstacle for the public to obtain justice and is not in accordance with the principles of the state of Indonesia as a state of law which is stated in the provisions of the 1945 Constitution of the Republic of Indonesia in Article 28D. Problem: Is the limitation of cassation in Article 45A of the Supreme Court Law in accordance with the provisions of the 1945 Constitution and the Criminal Procedure Code. This research is a normative research method with a statutory approach and a conceptual approach as well as prescriptive analysis techniques. The cassation legal effort should return to its basic purpose, namely maintaining legal uniformity and unity and providing justice for the community.

Abstract

In the application of laws and regulations in Indonesia, there are many weaknesses, one of which does not meet the concept of fair efficiency as regulated in Law Number 12 of 2011 concerning the Establishment of Legislations, both at the level of formation, application or law enforcement. Today, technology is experiencing an increasingly rapid development along with the times. The development of technology is something that cannot be touched. The role of law as a tool of social control involves the state to run it, therefore the role of the executive and legislature in making the rule of law is very important and dominant because the state has the obligation to protect all its citizens.

Abstract

Indonesia adalah negara kepulauan, sebaliknya bentuk negaranya adalah republik. Alasan mengapa negara Indonesia disebut negara kesatuan Republik Indonesia adalah karena meskipun negara Indonesia terdiri dari banyak pulau, masih dianggap sebagai satu negara dan negara adalah satu kesatuan yang dikenal sebagai Indonesia. Karena peristiwa proklamasi ini, bangsa Indonesia berhasil mendirikan negara, sekaligus mendeklarasikannya ke dunia luar (bangsa lain), dan sejak saat itu berdirilah negara baru, negara kesatuan Republik Indonesia. Indonesia (NKRI). Oleh karena itu, keberadaan Negara Kesatuan Republik Indonesia (NKRI) tidak dapat dipisahkan dari proklamasi kemerdekaan 17 Agustus 1945.

Abstract

The Ukrainian government is a presidential system, and the country is a unitary, democratic republic. Unitary states are characterized by the concentration of political and administrative power within the central government, which is located in Kiev. The president is the head of state and the head of government. He is elected by the people directly, which makes him the head of government as well as the head of state. In addition, the Prime Minister of Ukraine is the individual who is accountable for the day-to-day implementation of the policies that are implemented by the government. Ukraine's political structure displays a combination of aspects of presidential and parliamentary systems of government, with the prime minister lending a parliamentary feel to a traditionally presidential framework.

Abstract

Georgia, sebagai mantan negara konstituen Soviet, telah berkembang menjadi republik demokratis independen dengan sistem pemerintahan presidensial. Bentuk negaranya adalah sebuah republik, di mana presiden berfungsi sebagai kepala negara dan kepala pemerintahan. Sistem pemerintahannya terdiri dari tiga cabang yang independen: eksekutif, legislatif, dan yudikatif. Presiden dipilih langsung oleh rakyat dalam pemilihan umum setiap lima tahun. Legislatif diwakili oleh Majelis Nasional, terdiri dari dua kamar. Sistem pemerintahan Georgia bertujuan untuk memastikan keseimbangan kekuasaan antar cabang pemerintahan serta untuk mengukuhkan prinsip-prinsip demokrasi dan supremasi hukum di negara tersebut.
