Abstract

Halal certificate is a written fatwa MUI that states halal food products in accordance with Islamic law, aims to provide legal assurance to consumers. However, the existing regulations are still per-ceived sectoral, partial, inconsistent and not systemic. Moreover, the most fundamental thing is the halal certification is not an obligation (mandatory) for businesses but it is voluntary. Consequently, halal certification and halal label do not have strong legal legitimacy which results in legal uncer-tainty of halal food products. In regard to this, the draft of Law on Halal Product Guarantee that is still stalled in the House should be soon stipulated and MUI should be given the authority to issue halal certification and perform it through the Fatwa Commission LPPOM. In addition, the govern-ment serves as a regulator as well as supervisor in the implementation of the provisions of the law which cause justice uncertainty.Key words: halal certificate, the Indonesian Ulama Council, food products

Abstract

International Humanitarian Law (IHL) is a set of rules which is based on the 1949 Geneva Law and Hague Law in 1907 and equipped with Additional Protocols I and II of 1977. IHL seeks to provide protection to the victims of war and civilians in armed conflict (law of Geneva 1949) and what methods and tools that may be used in war (Hague Law 1907). The parties involved in armed conflict must respect the principles of limitation, proportionality and distinction. Violations of international humanitarian law called war criminals must be prosecuted as crimes against human rights. Enforcement of international humanitarian law carried out through the mechanism according to the 1949 Geneva Law, by temporary or ad hoc Court, and by the International Criminal Court (ICC). The method used in this research is normative qualitative approach by taking secondary data as a source of information. The results indicate that the consequences of Indonesia as a state to be a member of ICC are having the synergy process national law with Rome Statute covering criminal law, criminal procedural law, extradition, human rights court and the law of human rights itself. The final goals of the synergy are to make Rome Statuta as a follow up system of national judicial, to avoid conflict between ICC and the law of Indonesia, and to make internal law procedure for Indonesia when ICC jurisdiction is active in Indonesia Key words:  humanitarian law, war criminal, court jurisdiction

Abstract

The increase of regional chiefs who had been imprisoned for corruption makes Kemendagri (The Ministry of Home Affairs) issue a discourse to restore local elections to Parliament. Nevertheless, this discourse will not support the process of democracy in Indonesia. Instead, it pulls backwards into the era of the new order and causes any corrupt practices to move to other parties, from bribing people into Parliament. Hence what issued by the ministry is not the best solution. This paper discusses about how the correlation between direct local election and corruption behavior of regional chiefs. The solution to overcome this is done by changing the system ranging from political parties to the intensive monitoring involving active community over all government policies in regional level and the application of legal supremacy along with equality before the law firmly against corruption by impoverishment.Key words: politic of law, corruption, regional election

Abstract

This research is aimed at exploring an appropriate solution for various conflicts in land use, particularly in optimizing the utilization of the neglected land in Gili Terawangan, Lombok Island.  This solution is required to avoid potential horizontal conflicts among people, companies and government since 1993. Conflict over land in Lombok Island in general and Gili Terawangan particularly shows several factors; first, the wrong policy in the area of land (especially in tourist areas); second, the infirm attitude of the Party and the Government Land Office in the enforcement of laws; third, the jealousy of Gili Terawangan natives as cultivators; fourth, less responsibility employers (who acquire cultivating right); fifth, the absence of law protection for Gili Terawangan natives; sixth, the arrogant attitude of law enforcement officers. The comprehensive and final resolution to the conflicts of land use could only be achieved if: (i) the people, who already control and use or manage the land from time to time, are provided certainty on managing and optimizing the land based on the principles of welfare, justice, equity, efficiency and sustainability; (ii) the selection and determination of the companies that will be granted the right to cultivate (HGU) and the right to build (HGB) should be conducted based on the transparent principle. In this respect, the government could establish an independent team that involves all components of society and higher education.Key words: land dispute, tourism area, agrarian law.

Abstract

There is a strong relationship among capitalism, democracy and globalization. Jurists of the nine-teenth century have sought to create a legal structure that based on the idea of democracy and the free market, commitment to a democratic republic and the market system as required components of republic. Thus there is a kind of mutualism symbiosis between the demands of the enactment of democratic system and free market mechanisms. Accordingly, globalization, as a new form of capitalist expansion will be running well in any region in which democracy grows.Key words: capitalism, democracy, globalization, critical legal studies

Abstract

The purpose of this research is to find out the concept and benefit of regulation of no par value shares in Indonesian Capital Market. The legal issue of this research is the philosophical meaning of no par value shares as stipulated in Article 31 subsection (2) of Company Law 2007. Ontologically, regulation of no par value shares is one of alternatives to solve the crisis of capital market. Etiologically, the regulation will give the value of benefits in term of providing easiness to perform corporate action, simplification of accounting, no distinction between issued shares and outstanding shares, the shares price is not determined by the nominal price but the market price, it remains to be traded, the company may still do a rights issue to obtain fresh funds even during crisis and they can use mandatory and optional system.Keywords: regulation, no par value shares, capital market.

Abstract

Currently, the implementation of direct election for regional leader (pilkada) is not able to create people's welfare. Even it tends to harm the morale of state officials and people as well. In regard to this, the state should take immediate political measures   to change direct local elections law into indirect one. In the perspective of a democratic state, indirect local election is in line with the concept of Indonesian democracy and also in accordance with   legal politics for people’s welfare. Abstract

Dispute settlement of Industrial Relations through mediation stipulated in article 8 of the Act Number 2 Year 2004 was assisted by a mediator of manpower officials. In addition, article 9 regula-tes the qualifications of mediator. These two articles are very discriminatory as they are contrary to the fact that mediator of government officer should also be subject to the Civil Service Act. Besides, the government mediator would have superiors and subordinates according to the hierarchy of their positions. This would open possibility of intervention of the superiors that would interfere the mediator in performing his/her duties. Consequently, independent mediator would never be reali-zed. In fact, mediator is not only from government officer but also from other field such as lawyers, lecturers, National Commission of Human Rights (Komnas HAM), and any capable and non-allign-ed mediators. This would be one of solutions for the government to solve the shortage of mediators in Indonesia.                                                     Key words: mediation, mediator, law reform

Abstract

This study is aimed at describing constitutional and legal basis of MPU in Aceh, describing the history of existence of the Ulama’s roles in Aceh and also analyzing legal aspect and legal implication of deciding MPU Aceh concerning cult. The approaches used on this study are statute approach, cases approach, and historical approach. The result of analysis shows that fatwa issued by MPU Aceh concerning cult to several chairpersons of Islamic school (Pasantren/Dayah) in Aceh is against the law, especially Article 5 (b) Qanun Aceh No. 2 of 2009 on Aceh’s Ulama Consultative Assembly.         Keywords: fatwa, Aceh’s Ulama Consultative Assembly, cult

Abstract

Indonesia’s Investment Law and Negative Investment List (DNI) are not applicable to capital market transactions. Interpreted literally, this means foreign investors can arbitrarily increase their share participation in a company by engaging capital market transactions. This is not acceptable since the government puts a limit on foreign shares participation in certain business sectors. This normative-empiric study discusses practices in telecommunication industry that deviate from DNI, the conse-quences, and viable solutions. We found that literal interpretation is inconsistent to the objective of the DNI. We offer alternative approach that is more applicable and suitable to the given objec-tives.Keywords    :    negative investment list, foreign ownership restriction, portfolio investment, capital market transaction.
