Abstract

Domestic violence is a form of human rights violation that must be overcome. It is not surprising then that the government issued a regulation on the elimination of domestic violence or what is called the PKDRT Law. This law regulates standard terms related to domestic violence, the principles that form the foundation for the formation of the PKDRT law and also other rules that are criminal in nature. The research method used in this research is a qualitative method with a form and literature juridical approach. The results of the study state that the government's support for the elimination of domestic violence is based on a sense of humanity and human rights not to receive violence in any form from other people, including the family.Keywords: Domestic Violence; Positive Law Abstrak: Kererasan dalam rumah tangga merupakan bentuk perlanggaran hak asasi manusia yang harus ditanggulangi. Tidak heran bila kemudian pemerintah mengeluarkan regulasi undang-undang penghapusan Kekekerasan Dalam Rumah Tangga atau disebut dengan UU PKDRT. Dalam undang-undang ini diatur mengenai istilah-istilah baku terkait KDRT, asas-asas yang menjadi pondasi pembentukan undang-undang PKDRT dan juga aturan-aturan lain yang bersifat pemidaana. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan yuridis format dan literatur. Hasil penelitian menyatakan bahwa keberpihakan pemerintah terhadap penghapusan kekerasan dalam rumah tangga didasarkan adanya rasa kemanusian dan hak asasi manusia untuk tidak mendapat kekerasaan dalam bentuk apapun dari orang lain, termasuk pihak keluarga.Kata Kunci: KDRT; Hukum Positif
