Abstract

One of the main purposes of law is to uphold truth and justice. Laws is not merely seen as a compilation of regulations but reflection of society‘s ideas of moral values and ethics. The basic strength of law lies on its ability to disseminate ideas, and visions based on people’s experiences from time to time. The Qur‘an, as a source of Islamic law, explicitly instructs people to adopt and apply virtues and good ethics such as assigning trustworthy to those who can bear it and to consult with each other to reach a consensus and resolve disputes. This study is aimed at giving understanding toward the society about advantages of Islamic values and ‘âdah as a main source for settling land disputes. The goal of these values is to gain truth, virtue and justice. The study found some model of land dispute resolutions. However, the most popular method taken by people is resolution out of courts (non-litigation) where religious or local figures often acted as the mediator of the conflict.

Abstract

This study examines the roles and tasks of the Office of Marriage Counseling, Guidance and Preservation (BP4) in maintaining marriage in the globalization era. It is assumed that the Office is needed to give advice and counseling for the family to maintain its continuity. The study was carried out in Bengkulu and focused on the BP4’ roles. The study reveals people’s perception of the BP4, its roles and achievement. Although the BP4 has already succeeded in mediating broken families and these families can be reconciled, its systematic and comprehensive ways in realizing all its roles still in many ways need improving. This study, therefore, offers some concepts and ideas that the Office needs to take into consideration if it wants to improve its role in the future.

Abstract

This study examines two issues; first, the social aftermaths of the violence and, second, the conflict resolution sponsored by the government of West Nusa Tenggara Province. The study maintains that the violence against Ahmadiyah members has stimulated internal solidarity because, among other things, the community believes that the violence is a challenge to defend their faith. Such a strengthening communal bond has made them survive despite the fact that they lose their political rights as citizens. Although they are now living temporarily for years in a boarding house provided by the local government, some community members have begun their life and worked normally. On the other hand, there has been seemingly no serious effort ever made by the government to resolve the conflict in terms of conflict anticipation, reconstruction of destroyed buildings, peace-building and reconciliation. The government’s effort that is aimed to anticipate conflicts is realized through the issuance of joint decree between three ministerial offices. The reason for the issuance of the joint decree is because this is seen as an effective way to anticipate conflicts since the government and the opponents of Ahmadiyah conceive of the conflict as a religious or faith-based conflict in which reconciliation might be futile.

Abstract

This paper discusses the form and diversity of religious traditions among the Javanese community in Tondano, North Sulawesi. For the Javanese in that area, religious traditions serve as a distinct symbol that culturally and ideologically distinguish them from others. Besides, their religious traditions constitute the most effective medium to preserve their identity as Muslim and Javanese. Nevertheless, their distinctive traditions have hardly become troublesome that deters them from making harmonious relations with their surrounding communities who hold different ideology and culture. This study reveals that the changing time and modernity do not significantly impede them from practicing their religious traditions. The community of Kampung Jawa in Tondano, Minahasa, has consistently maintained the religious traditions that they inherited from their forebears.

Abstract

Hermeneutical method introduced by Farid Esack promotes a model of interpretation that combines texts and contexts. This means that interpretation begins from texts and is applied to contexts and then moves from contexts back to texts. It is thus a dialectical process where understanding of contexts should be confirmed to texts and the result of this process is used as a guideline of practice. This hermeneutic is grounded on some Qur’anic key words, such as taqwa, tauhid, al-nas, al-mustadl’afûn fi al-ardh, ‘adl, qisth, and jihad, to avoid arbitrary interpretation of the Scripture. Applying Esack’s hermeneutic to interreligious relations, this study argues that interreligious cooperation between Muslims and non-Muslims is not forbidden but encouraged. This conclusion comes from the understanding of the verses pertaining to plurality of religions, religious affinities, and the story of Moses exodus and Israel children from Egypt. In these three examples, the Qur’an explicitly and implicitly gives respects and admits the truth of religions. Therefore, interreligious cooperation between Muslims and non-Muslims should be built up on this theological consciousness.

Abstract

This study describes the manager’s effort of waqf (endowment) to make it productive. The study focuses on the ways in which the waqf manager (nadzir) endeavors to get or expand funds to support for the pesantren’s independence. Using qualitative method, this field research examines the waqf management in two pesantrens as a cases study in Tebuireng in Jombang and Gontor in Ponorogo, both in East Java. The study finds three models of endowment management; first, the manager uses available potential waqf funds or appointing a new manager. Second, the manager creates new resources taken from productive waqf funds, and third, monetizes non-financial waqf resources.

Abstract

Some experts argue that Islam initially spreading in the archipelago was highly influenced by Sufism. One of the advantages of the approach taken by Sufis was that Islam was relatively tolerant with local culture. Because of such an approach, various local people could easily accept Islam, including those coming from rural and remote areas. Some Muslim religious scholars (ulama) recorded this Islamization in their works and manuscripts. One of the manuscripts was written by Abdul Malik bin Haji Abu Bakar Krui Penengahan Lahai. This important document was found in an inland area of West Kalimantan. Through philological and historical examinations to this manuscript, this study finds that Sufism that was spreading in that area was affiliated to Qadiriyah wa Naqsyabandiyah sufi order. The text explicitly refers to Fath al-‘Ârifin work, written by Khatib Sambas, the founder of the Qadiriyah wa Naqsyabandiyah sufi order. One important teaching offered by this Sufism is the integration between sharia and tasawuf. The text also reveals that the spread of Islam did not neglect to accommodate local culture.

Abstract

In its initial establishment, the education offered by the Nahdlatul Wathan, a local Islamic socio-religious organization, received a very small response from people in Lombok. It was even seen controversial in some instances because the purpose of the education was conceived of being contrary to the fundamental principle of local education. The question is then how the educational institutions affiliated with the Nahdlatul Wathan have survived so far? This study demonstrates that the education promoted by the Nahdlatul Wathan has successfully assured the people about some crucial issues. First, the meaning of education is to humanize students (humans) through intensive programs of developing their potencies for their future. Second, the education contributes to the dissemination of positive values and functions as formation of intellectuality, creativity and proficiency. Third, the ultimate objective of education is to reach prosperity in this world and hereafter. Fourth, the teacher has responsibility to forge their pupils to reach educational goals. Furthermore, the teacher in the Nahdlatul Wathan’s concept of education must master relevant sciences and knowledge and have high moral and spiritual standards. Fifth, students must live in a good environment that can make teaching and learning processes successful.
