Abstract

The purpose of this paper is to identify and analyze the modus operandi of illegal fishing practices and efforts to combat illegal fishing practices in the Indonesian Exclusive Economic Zone. Writing scientific papers uses normative research. This paper uses a statute approach and a conceptual approach. The technique of tracing legal materials uses document study techniques and the analysis of studies uses qualitative analysis. The study results show that the modus operandi used in illegal fishing practices in Indonesia's EEZ includes fishing without a permit, fishing using fake permits, fishing using illegal fishing gear and catching fish with types or species that are not in accordance with the permit. Indonesia as a coastal country can carry out efforts to combat illegal fishing practices through authorized law enforcement officials in accordance with the provisions of laws and regulations.

Abstract

The number of space activities carried out by countries causes more space debris and will harm the earth's ecosystem and space. This article aims to find out how the international arrangements for countries' responsibilities for the existence of space debris and what can be done to overcome space debris. The research in this article uses normative research methods that use a statutory approach. This article results, where according to the international legal instruments used in the space debris problem, countries must be responsible for damage caused by the launch of space objects. Such responsibilities can based on mistakes made by the launch countries. Efforts to overcome space debris are by creating recommendation and guidline mechanisms used by countries and space agencies in the implementation of space activities. However, it is necessary to establish an international environmental tribunal to address court proceedings that cannot be effectively conducted by existing courts.

Abstract

The emergence of online or fintech loan providers is caused by changes in people's lifestyles. This innovation can be said to bring benefits to the community because the loan requirements are quite easy so there is no need to go to the bank to apply for a loan, especially the use of paylater as a means of transaction. The journal was written to examine the arrangements as well as the validity and disputes arising. The method of writing this journal is done in normative juridical. Fintech companies cooperate with various online shopping application platforms or marketplaces such as Shopee, Tokopedia and others that offer payment methods such as Pay Later or payment methods with installments without credit cards or online credit, as borrowers must follow the flow or system of borrowing that is true or valid by choosing a platform that is completely registered and supervised by OJK and incorporated in Indonesian Fintech Association in order to avoid things that can cause losses. The legality of the use of PayLater, can be reviewed the validity of which is first in terms of organizers stipulated in Article 2 POJK Number 77 year 2016 declared as “Other Financial Services Institutions”. Online lending has been officially regulated in the legislation in Indonesia, called The Financial Services Authority Regulation Number 77/PJOK.01/2016 of 2016 about “Information Technology-based Money Lending Services”.

Abstract

Tujuan penulisan dalm artikel ini supaya para pembaca dapat menelaah dan mempunyai ilmu tentang apa yang terjadi pada Pengesahan Rancangan Undang-Undang Penghapusan Kekerasan Seksual dalam Hak Asasi Manusia (HAM) dan Problematika Norma dalam Rancangan Undang-Undang Penghapusan Kekerasan Seksual yang sempat terkendala pengesahannya sampai akhirnya Rancangan Undang-Undang tersebut disahkan. Metode Penelitian pada artikel ini yaitu metode hukum normatif. Berdasarkani hasil penelitian, permasalahan yang dihadapi dalam pengesahan Rancangan Undang-Undang Penghapusan Kekerasan Seksual di Indonesia mencakupi beberapai hal yakni permasalahn yang berkaitan dengan norma, landasan dan membutuhkan kepastian hukum yang bukan hanyai diperuntukan bagi perempuan saja tetapi juga semua pihak baik laki-laki, anak-anak dan penyandang disabilitas. Selanjutnya problematika pembentukan produk hukum Rancangan Undang-Undang Penghapusan Kekerasan Seksual tersebut didasarkan untuk mengisi kekosongan hukum. Hal inilah yang kemudian membuat masyarakat mendorong pemerintah agar Rancangan Undang-Undang Penghapusan Kekerasan Seksual segera disahkan. Kata Kunci: Urgensi, Problematika, Rancangan Undang-Undang ABSTRACT The purpose of writing this article is so that readers can examine and have knowledge about the Draft Law on the Elimintation of Violence in the Draft Law on the Eliminationn of Violence, which had problems with its ratification until finally the Draft Law was ratified. The research method in this article is the normative legal method. Based on the results of the research, the problems faced in the ratification of the Draft Law on the Elimination of Sexuality in Indonesia include severalissues, namely problems relatin to norms, foundations and requiring legal certainty which are not only intended for women but also all parties, both men, children, women and person with disabilities. Furtheremore, there are problems with the formation of the Legal product of the Law on the Elimination of Violence based on the draft law. This is what then makes the community push the government si that the Draft law on the Elimination of Sexual Violence is immendiately ratified. Keywords: Urgency, Problems, Draft Law

Abstract

Tujuan penulisan ini untuk membahas pengaturan hak-hak pekerja dalam UU No. 11 Tahun 2020 dan juga untuk menganalisis implikasi UU No. 11 Tahun 2020 terhadap jaminan hak-hak pekerja. Jenis penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konsep digunakan dalam penelitian ini. Hasil penelitian menunjukan pengaturan hak-hak pekerja dalm UU Ciptaker masih memiliki permasalahan atau problem norma yaitu belum berkepastian hukum terhadap penjaminan perlindungan hak-hak buruh yang meliputi pengupahan yang layak serta kesesuaian uang pesangon. Dalam hak jaminan terhadap hak buruh, UU Ciptaker “hanya mengakomodir kepentingan pengusaha sehingga dapat berimplikasi pada pemutusan hubungan kerja secara sepihak. Kata Kunci: Pengaturan, Hak-Hak, Pekerja, Cipta Kerja. ABSTRACT The purpose of this paper is to discuss the regulation of workers' rights in Law no. 11 of 2020 and also to analyze the implications of Law no. 11 of 2020 on the guarantee of workers' rights. The type of normative juridical research with a statutory approach and a concept approach is used in this research. The results of the study show that the regulation of workers' rights in the Copyright Act still has problems or normative problems, namely there is no legal certainty about guaranteeing the protection of labor rights which includes proper wages and severance pay. In terms of guarantees for labor rights, the Ciptaker Law “only accommodates the interests of employers so that it can have implications for unilateral termination of employment. Abstract

Fenomena yang terjadi yakni beberapa pengusaha yang bergerak di Industri perhotelan dan industri makanan melanggar batas sempadan pantai sejauh 100 meter dari pinggir pantai. Pelanggaran tersebut membuat area publik berupa pantai di kawasan Sanur selatan menjadi area privat bagi sebagian pengusaha dimana hal tersebut merugikan masyarakat publik secara umum. Penelitian bertujuan mencari tahu peraturan hukum teerkait pemanfaatan sempadan pantai sebagai area privat di Wilayah Provinsi Bali dan untuk mengetahui penggunaan sempadan pantai menjadi area privat oleh hotel serta restoran pada Wilayah Sanur Selatan. Metode penelitian yang dipergunakan yakni metode deskriptif, pendekatan hukum empiris. Metode analisis data yang dipergunakan yakni analisis data kualitatif. Adapun hasil dari penelitian ini adalah dimana peraturan hukum terhadap penggunaan sempadan pantai sebagai area privat di Wilayah Provinsi Bali dijelaskan pada Perda No. 16 Tahun 2009 mengenai Rencana Tata Ruang Wilayah Provinsi yang menyatakan bahwa sempadan pantai dalam penggunaan lahan pesisir termasuk alam dan pantai sebagai bagian dari hak public. Selain itu Peraturan Presiden (Perpres) No. 51 Tahun 2016 mengenai Batas Sempadan Pantai Pasal 1 Ayat 2 menyatakan, Sempadan Pantai ialah suatu daratan sepanjang tepi pantai. Lebarnya proporsional selaras dengan bentuk serta keadaan fisik pantai, paling sedikit 100 meter dari titik pasang paling tinggi kearah daratan. The phenomenon that occurs is that several entrepreneurs engaged in the hotel and food industry violate the coastal border as far as 100 meters from the beach. This violation has made a public area in the form of a beach in the southern Sanur area a private area for some entrepreneurs, which is detrimental to the general public. This study aims to find out the legal regulations related to the use of the coastal border as a private area in the Province of Bali and to find out the use of the beach border as a private area by hotels and restaurants in the South Sanur Region. The research method used is descriptive method, empirical legal approach. To analyze the data, used qualitative data analysis. The results are where the legal regulations on the use of coastal borders as private areas in the Province of Bali are described in Perda No. 16 of 2009 concerning the Provincial Spatial Plan which states that the coastal boundaries in the use of coastal land include nature and beaches as part of public rights. In addition, Presidential Regulation (Perpres) Number 51 of 2016 concerning Coastal Borders Article 1 Paragraph 2, explains that the Coastal Border is a land along the coast. The width is proportional to the shape and physical condition of the beach, at least 100 meters from the highest tide point towards the mainland.

Abstract

ABSTRAK Tulisan ini bertujuan untuk mengetahui keterkaitan pengaturan dengan uang elektronik di Indonesiaserta mengetahui akibat hukum yang terhadap maraknya jasa modifikasi desain kartu uang elektronikyang cenderung tidak resmi dan ilegal. Metode penulisan yang digunakan dalam jurnal ilmiah ini yakninormatif dengan mengacu pada pendekatan perundang-undangan (statute approach) dan pendekatan analisis konsep hukum (conceptual approach). Saat ini pengaturan mengenai uang elektronik termuat dalam PBI 20/6/PBI/2018, apabila dikaitkan dengan Undang-Undang Hak Cipta maka dasar hukum terkait motif pada kartu uang elektronik ada pada Pasal 40 ayat 1 huruf f. Apabila motif pada kartu uangelektronik ingin di modifikasi oleh pihak ke-3, maka Pihak ke-3 harus mendapatkan izin dari bank selakupenerbit untuk dapat memperoleh hak ekonomi dengan melakukan pembagian royalti antara bank sebagaipenerbit dan pihak ke-3. Apabila tidak mempunyai izin dari bank selaku penerbit maka modifikasi kartu emoney tersebut dikaitkan dengan UUHC (Undang-Undang Hak Cipta), maka terhadap pelaku jasa modifikasi kartu uang elektronik merupakan tindakan yang ilegal dan terhadapnya diancam sanksi pidana maupun sanksi perdata. Kata kunci: Modifikasi, Desain, Kartu Uang Elektronik ABSTRACT This paper aims to determine the relationship between regulation and electronic money in Indonesia andto find out the legal consequences of the proliferation of electronic money card design modificationservices which tend to be unofficial and illegal. The writing method used in this scientific journal isnormative with reference to the statute approach and the legal concept analysis approach (conceptualapproach). Currently, the regulation regarding electronic money is contained in PBI 20/6/PBI/2018, if itis associated with the Copyright Law, the legal basis for the motif on electronic money cards is in Article40 paragraph 1 letter f. If the motive on the electronic money card wants to be modified by a 3rd party, the3rd party must obtain permission from the bank as the issuer to be able to obtain economic rights bydistributing royalties between the bank as the issuer and the 3rd party. If you do not have permissionfrom the bank as the issuer, then the modification of the e-money card is linked to the UUHC (CopyrightLaw), then the perpetrator of the electronic money card modification service is an illegal act and isthreatened with criminal sanctions as well as civil sanctions.
