Abstract

There are a lot of problems in the Indonesian royalty system. One of the problems is the overlapping collecting societies authorities. Finding the way to harmonize several collecting societies whose overlapping authority is the goal of this article. And based on the writer research, there are two ways to harmonize the overlapping collecting societies. First is centralizing collecting societies’s authority in one institution. And second is distributing the collecting societies’s authority. Goverment as the highest instituion in the state has to support by making a regulation for the collecting sociceties.

Abstract

Common but Differentiated responsibility is one of the principles which has been adopted in the Kyoto Protocol. Common but differentiated responsibility requires us to recognize that because of historical circumstances, countries at different stages of development have different capacities, and consequently different levels of kind of responsibility for dealing with international environmental issues.  Implicit in this dichotomization is the notion that developing countries lack sufficient technical expertise, regulatory and administrative efficacy, and economic capability to reduce green house gases.  The Implementaion of  common but differentiated responsibility principle under the Kyoto Protocol embodys in three flexible mechanisms. These mechanism include emission trading, joint implementation, and clean development mechanism. To maintain the broader participation from develop and developing countries the Implementaion of  common but differentiated responsibility principle should be based on equity principle.  However, without the participation of the United States to the Kyoto Protocol mechanisms cause the implementation of the protocol less effective because the United States is the biggest emitter in the world.

Abstract

Various government’s policies implemented through Precedential Decrees (Keppres), Precidential Instruction (Inpres),  and Precedential Regulation (Perpres), since the New Order up to the Reformation Order, have brought about the  increase of the social welfare among fishermen, especially through the schemes such as Undeveloped Regions Precedential Instruction (IDT) and  Social Security Network (JPS). However, those schemes seem to  be an ad-hoc solution which does not relate functionally to the Act on Social Welfare (UU Kesejahteraan Sosial) and the Act on Fishery Profit Sharing (UU Bagi Hasil Perikanan). Consequently, the availability of a sustainable program on social welfare cannot be achieved  since the function of  a presidential policy different from the function of an act.

Abstract

Idea of Human Right as universal ideology has been agreed by the nations and poured in Universal Declaration of Human Rights released by United Nations on 1 December 1948. This declaration aims to protect the rights of human being and pushs the creation of freedom of human being without colour line, gender difference, Ianguage difference, and also religion difference. The protection of Human Rights regulated also on Rome Statute on the International Criminal Court becoming base to forming of International Criminal Court (ICC). In this time ICC faces some constraint influencing its effectivity in doing the role. But, the constraint do not eliminate its role in the effort of straightening of Human Rights

Abstract

The born of digital image creation in the Internet stipulates legal impacts. One of the impacts  is  copy rights law. The copy rights law should be  able to respond the digital image phenomena in the internet. The Indonesian Copy rights law  is regulated on the Act No. 19 /2002.  In fact, this Act has regulated digital creations in  the internet. This indicates that the Act provides protection to the creations. Is it true ?

Abstract

Principally, the phenomenon of cyber porn has been provided in the existing criminal laws, both in the Code of Criminal Law (KUHP) or in other regulations. However, it should be considered that these existing laws need for reformation and enhancement in order to be more effective in their enforcement. More stronger punishment and clearer jurisdiction in handling the cases are among the aspects which shall be covered by the amendment.

Abstract

Labor Law in Indonesia is one of specific law that has a main goal to protect the workers in front of entrepreneur’s power. This article uses normative method in analyzing the interrelation of Constitutional State, Democracy, and Administrative Law, in Labor Law aspect, especially on the government intervention to the worker and entrepreneur relationship. Based on a democratic and constitutional state, the government shall protect and respect human rights of citizen by using juridical instruments. Thus, in fulfilling his duties in labor aspect, the government has a responsibility in order to reach a social justice between the parties in working relationship. Also, the government has a responsibility to interfere the working relationship between parties by some limitations and regulations of the Indonesian Democratic and Constitutional State based on Pancasila.

Abstract

This article illustrates the relationship between the role of law, especially competition law and economic development. Competition law is prerequisite of free market which gives us some advantages, including competitive price, increasing the quality of life and the social mobility, as well as efficiency both allocative and productive. Those advantages, however, only established if there are five qualities in law which render it conducive to economic development, such as stability, predictability, fairness, education, and special development abilities of law enforcer.

Abstract

Phylosophy through its branchs could be used to analyze a problems deeply untill we found the essence of the problem. It brings a person to have philosophical thinking untill he draw integrated and focused conclusion. To analyze the position of legal science in the science, so it needs philosophical thinking. It will brings a legal development which not only able to reached current legal problems in society, but also future legal problems. Legal science development decided by the development of onthology, ephistimology, and acsiology aspects of legal science.
