Abstract

The direct residential as well as provincial election may pave the way for the enhancement of the quality of democracy. It is unfortunate however, that among those elections have raised the conflict and social unrest, which led to the lack of recognition of the elected candidates, and finally the cases then are brought to the court.  Legal provisions pertaining to the way these disputes shall be settled are also have not yet been synchronized. This brings about that General Election Commission (KPU) as well as Local Election Commission (KPUD) and the Supreme Court (MA) hold their own legal  interpretations which differs each from others.

Abstract

The development of Legal Science in Indonesia has disappointed the society, since the products of law give no good benefit impact even make more difficulties without any problem solving as the main point of the products. It seems that Legal Science in Indonesia is stuck between Continental and Anglo Legal Systems. Science Philosophy is the right tool to give the basic and direction to the development of legal Science in Indonesia, because the aspects of Science Philosophy, as Knower, Knowing, and Knowledge, will lead the Legal Science in Indonesia developed in the right track. The Legal Science in Indonesia should be based on the religious, humanity, united in diversity, democracy, and social justice, as the basic philosophy of Indonesian nation.

Abstract

Islamic financial transactions, particularly in Islamic banking business, is a new mode of financial transaction in the nomenclature of the law of contracts. Different from conventional financial transactions which have been established for a long time, Islamic financial transaction is a newly introduced and is still evolving to find out its ideal form. Having said this, dispute settlement for cases arising from the Islamic financial transactions certainly need sufficient attention from the judicial authority in Indonesia. If for about fiveteen years dispute settlement in this matter was under the authority of the Shariah Arbitration Panel (Basyarnas), today, this dispute settlement can be brought to the court of juctice. It is made possible by virtue of the issuance of the Act no. 3 of 2006 on Religious Court and also the approval of the bill of Shariah Banking Act by the members of parliament. This fact suggests that for Indonesia necessary preparations pertinent to the court sistems to be rady in hadling the cases are strongly demanded. In this situation, Malaysia’s experiences in matters pertinent to dispute settlement of Islamic financial business through the court is a good case to be learned.

Abstract

This article aimed to study The Failure of Implementation of Good Corporate Governance (GCG) on Public Companies in Indonesia. Implementation GCG, specifically in public companies, is very important because it could enhanced corporate profit and shareholder gain in long term By using normative legal methods, this article demonstrated: First; GCG is a concept emphasizing the importance of the user right of financial statement to get the information accurately and timely; and the company management liability to provide the information accurately and perform the company fundamental value. Second; implementation GCG failed in Indonesia. It just because many public companies still hesitated to fully implement GCG. Third, Indonesia does not need more law. What is needed is a changed legal culture that will put to work these laws and institutions as they are designed to be used and commitment in every aspect of professional life to implement GCG.

Abstract

Basically, economic analysis towards criminal law relates to two points namely, rationality and efficiency. Rationality denotes that a person, in committing a crime always takes the cost and benefit into account. While efficiency means that a crime offender tends to use certain way which is less costly in committing the crime. An optimum criminal law enforcement, therefore,   may be achieved  through a certain method which takes the following three aspects into account; the benefit which is gained by the criminal offender, the lost which is caused by such crime, and also, the expenditure caused by  legal enforcement activities

Abstract

The central government policy which granted the autonomy for some local governments has brought about the rise of local regulations which are drafted in accordance with the local aspirations. Accordingly, for the residences where their socio-historical backgrounds are marked with Islamic tradition, tends to aggregate Islamic values in the regulations they issue.

Abstract

Cutting hand penalty for theft cases, according to Muslim jurists’ view, is a maximum penalty, and hence, not all of such cases deserve for this mode of penalty. In case that the requirements for the implementation of such penalty cannot be found in a theft case, cutting hand may not be implemented and ta’zir shall apply instead. Ta’zir then, is considered as an educative penal system which falls under the authority of the judges to exercise their ijtihad capability.
