Otoritas Jasa Keuangan yang diatur dalam Undang-Undang Nomor 21 Tahun 2011 merupakan suatu lembaga baru yang mempunyai fungsi, tugas, dan wewenang dalam hal pengaturan dan pengawasan dalam kegiatan jasa keuangan yang salah satunya adalah Pasar Modal. Namun, dalam proses kepailitan Perusahaan Efek yang merupakan bagian dari jasa keuangan Pasar Modal tersebut belum diatur secara tegas di dalam undang-undang tersebut. Permasalahan yang ingin dibahas dalam penelitian ini adalah dasar hukum pengajuan pailit kepada perusahaan efek oleh Otoritas Jasa Keuangan (OJK) dan bentuk dari konsep Wewenang Pengaturan ataukah konsep Wewenang Pengawasan dalam hal fungsi, tugas dan wewenang OJK pada Proses Kepailitan Perusahaan Efek. Penelitian ini merupakan penelitian normatif dengan menggunakan metode pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sejarah. Hasil dari penelitian ini adalah bahwa dasar hukum untuk pengajuan kepailitan kepada Perusahaan Efek oleh OJK masihlah belum ada, sehingga OJK segera mungkin harus mengeluarkan peraturan pelaksana untuk kepailitan Perusahaan Efek tersebut agar tidak ada kekosongan hukum dalam hal tersebut.Financial Services Authority regulated in Law Number 21 in 2011, is a new institution which has the functions, duties and authority in terms of regulation and supervision in the financial services activities, one of which is the capital market. However, in bankruptcy proceedings securities company that is part of the Capital Markets financial services have not been set forth in the Act. The problems to be discussed in this study is on what legal basis the company filing for bankruptcy to effect by the FSA and is the concepts of Privileges Setting Supervision Authority in terms of the functions, duties and authority of the FSA on Bankruptcy Process Securities Company. This is a Normative Research. The results from this research is that the legal basis for the bankruptcy filing to the Securities Company by FSA is still not yet exist, so the FSA soon may have to implement regulations for the securities company bankruptcy so that there is no legal vacuum in that regard.

Terbentuknya Border Liason Committee (BLC) antara Indonesia dan Timor Leste merupakan kerjasama sosial, ekonomi, dan budaya masyarakat perbatasan, sekaligus memberikan dukungan terhadap permasalahan perbatasan antara Indonesia dan Timor Leste. Implementasi BLC dalam kerjasama Indonesia dan Timor Leste yaitu konsolidasi antar anggota BLC yang bertujuan untuk menyamakan persepsi, rencana kegiatan serta penganggaran, menginventarisasi permasalahan dan penyelesaiannya, serta menggali potensi kerjasama sosial ekonomi dan budaya misalnya dalam bidang perdagangan lintas batas, kesenian, kebudayaan, adat, pendidikan, dan olah raga. Di mana peran BLC diharapkan mampu memberikan kontribusi pada pemerintah pusat untuk mengambil kebijakan yang tepat untuk penyelesaian permasalahan yang tengah dihadapi oleh kedua negara.The establishment of a Border Liason Committee (BLC) between Indonesia and Timor Leste is a social, economic, and cultural cooperation between border communities, while providing support for border issues between Indonesia and Timor Leste. Implementation of BLC in cooperation between Indonesia and Timor Leste is consolidation among BLC members which aims to equate perception, activity plan and spreading, inventory the problems and settlement, and explore the potential of socio-economic and cultural cooperation such as cross border, art, culture, education, and sports. Where the role of BLC is expected to contribute to the central government to take the right policy to solve the problems faced by both countries.

PROSES MEMBENTUK PERUSAHAAN BARU DALAM PELAKSANAAN EKSPANSI PERUSAHAAN GROUP DI SEKTOR PERTAMBANGAN BATUBARA Hartana Hartana

Sepuluh tahun terakhir merupakan masa pertumbuhan perusahaan pertambangan batubara di Indonesia yang sangat pesat. Hal ini dikarenakan meningkatnya permintaan batubara sebagai pemasok energi di masa mendatang sehingga membuat industri ini memiliki daya tarik yang sangat besar bagi para investor dan banyak perusahaan batubara yang mengajukan Izin Usaha Pertambangan (IUP). Pemerintah telah menetapkan proyek pembangunan melalui proyek pembangkit listrik 35.000 MW. Metode penelitian yang digunakan bersifat yuridis empiris yaitu cara prosedur yang dipergunakan untuk memecahkan masalah penelitian dengan meneliti data sekunder terlebih dahulu untuk kemudian dilanjutkan dengan mengadakan penelitian terhadap data primer di lapangan. Dalam hasil penelitian, adapun cara yang digunakan oleh perusahaan pada sektor pertambangan dalam melakukan ekspansi adalah melalui cara pembentukan perusahaan baru. Ekspansi perushaaan pada sektor pertambangan tentunya memberikan beberapa implikasi yang bisa mengarah pada timbulnya praktek monopoli dan persaingan usaha tidak sehat, mengingat bertambahnya jumlah perusahaan. Adapun produksi yang dilakukan oleh empat group batubara terbesar, masing-masing belum mencapai nilai 75% dari produksi nasional, sehingga sesuai Undang-Undang No. 5 Tahun 1999 Pasal 4 ayat (2) ekspansi yang dilakukan oleh perusahaan group tersebut tidak terbukti berimplikasi terhadap adanya praktik monopoli dan persaingan usaha tidak sehat.The past ten years, coal mining industry in Indonesia develop very rapidly. Coal mining industry becomes the strong magnet for investors and coal companies who submitted for the Mining License (IUP) as a result from high demand of coal supply to be used as energy supplier in the future. The Government has set up the development project of 35.000MW power plant. The method for the research is juridical empirical. It is a problem solving procedure by investigating secondary data first to be able to continue with the primary data. As the result, mining companies expand their business through the new company establishment. Of course those ways of company’s expansion will lead to the implication of monopoly and unfair business competition, considering the increasing numbers of new companies. However, the total production forms the top 5 coal mining group companies has not reach 75% of national production, thus, according to the Law no. 5 Year 1999 article 4 paragraph 2, the company’s expansion does not implicate on the monopoly and unfair business competition.

Penelitian ini memaparkan tentang fenomena kasus kejahatan seksual yang pada awal tahun 2016 terjadi di Indonesia, di mana perbuatan pelaku yang melakukan persetubuhan dengan anak (pedofilia) membuat posisi anak semakin terancam, serta mengakibatkan anak mengalami trauma secara fisik dan mental. Penegakan hukum dalam proses peradilan perlu diperkuat agar menimbulkan efek jera bagi pelaku yang melakukan persetubuhan dengan anak (pedofilia). Penguatan penegakan hukum itu dapat dilakukan melalui politik hukum dengan menerapkan tindakan kebiri kimia. Beberapa kasus kejahatan seksual tersebut menyimpulkan bahwa pidana penjara yang dianut dalam Undang-Undang Perlindungan Anak tidak memberikan efek jera, maka perlu menerapkan sanksi baru yang menjadi pidana tambahan dan tindakan yakni dengan penggantian hukuman lama atau penerapan hukum baru melalui kebijakan negara antara legislatif dan eksekutif. Sanksi dalam bentuk penerapan kebiri kimia yang tujuannya untuk menghilangkan nafsu seksual pelaku yang melakukan persetubuhan dengan anak (pedofilia).This research explains about the phenomenon of sexual crimes at the beginning of the year 2016 happen in Indonesia, the perpetrator who commits coitus with children (pedophilia) made the position of the child increasingly threatened, as well as resulting in a severely physically and mentally traumatized. So that the rule of law in the judicial process needs to be reinforced in order to pose a deterrent effect for the offender who commits coitus with children (pedophilia). The strengthening of the rule of law can be done through political action by applying the law of chemical castration. Some sexual crime cases concluded that criminal prison adopted in the act of child protection does not give deterrent effect, therefore, need to impose new sanctions and the act replacement or application of new law through the country policy between legislative and executive. The act of this chemical capon directed to reduce sexual crime, especially pedophilia, and handling sexual attack that occurred in Indonesia.

Penelitian ini bertujuan untuk mengetahui pelaksanaan asas-asas umum pemerintahan yang baik (AAUPB) sebagai dasar bagi penyelenggara pemerintahan untuk menjamin terwujudnya kesejahteraan warga negara. Pendekatan masalah dalam penelitian ini menggunakan Statute Approach dan Conceptual Approach. Hasil Penelitian menunjukan bahwa AAUPB dapat diibaratkan sebagai rambu lalu lintas dan pedoman perjalanan dalam rangka memperlancar hubungan pemerintahan yaitu antara pemerintah dan yang diperintah atau warga masyarakat. Apabila penyelenggara negara bertindak bebas tanpa harus terikat secara sepenuhnya kepada undang-undang maka akan membuka peluang bagi penyalahgunaan kewenangan. Di dalam penyelenggaraan negara membutuhkan adanya pembatasan kekuasaan pemerintah (negara) dengan tujuan untuk memberikan perlindungan terhadap hak-hak individu. Penyelenggara negara yang dilaksanakan oleh pemerintah sebagai unsur utama penganyom dan pelayan masyarakat mempunyai peran penting dalam mewujudkan kesejahteraan warga negaranya/masyarakat. Setiap tindakan penyelenggara pemerintah harus selalu dilaksanakan berdasarkan hukum yang berlaku, baik hukum yang tertulis maupun hukum yang tidak tertulis. Namun asas-asas umum pemerintahan tetap memiliki arti dan fungsi yang penting dalam praktik penyelenggaraan pemerintahan. Oleh karena itu, sebagai tolok ukur untuk menilai penyelenggara negara telah sesuai dalam menjalankan tindakannya dalam negara hukum, maka dapat menggunakan asas-asas umum pemerintahan yang baik.This study aims to determine the implementation of Good Governance Principles (AAUPB) as the basis for the government in performing its duties as a form of guarantee for the welfare of the citizens. This is a normative research with Statute and Conceptual Approach. Research results show that AAUPB can be likened to traffic signs and travel guidelines in order to facilitate government relations between the government and the citizens. If the state organizer acts independently without having to be fully bound by the law it will open up the opportunities of authority abuse. That’s why the state administration requires such restriction of government power (state) with the aim to provide protection against the individual’s rights. State organizers in this case is the government as the main element that is caring, and as a public servants have an important role in realizing the welfare of its citizens/community. Every act of government organizer shall always be carried out in accordance with the applicable law, both written law and unwritten law. However, the general principles of governance still have important meanings and functions in the governance practice. Therefore, as a benchmark to assess whether the state organizers are appropriate in carrying out their actions within the rule of law, it can use the general principles of good governance.

Ekonomi kreatif erat hubungannya dengan hak cipta karena perkembangan ekonomi kreatif berfokus kepada penciptaan barang dan jasa dengan mengandalkan keahlian, bakat dan kreativitas yang dapat mendatangkan manfaat ekonomi kepada penciptanya. Permasalahan yang diajukan pada penelitian ini adalah perlindungan hukum dan penyelesaian sengketa hak cipta fesyen terhadap ekonomi kreatif dalam Masyarakat Ekonomi ASEAN, membuat hak cipta fesyen rentan terkena pembajakan karena MEA memberlakukan pasar tunggal terhadap negara anggota ASEAN. Pembajakan mengakibatkan pencipta mengalami kerugian moril karena merasa hasil karyanya tidak dihargai dan kerugian materiil karena hasil karyanya telah tersebar namun tidak memberikan insentif kepada pencipta. Bentuk perlindungan hak cipta terhadap ekonomi kreatif dalam MEA terlihat dari kebijakan pemerintah memperbaharui UUHC dan pengesahan Peraturan Presiden No. 72 Tahun 2015 tentang Perubahan Atas Peraturan No. 6 Tahun 2015 tentang Badan Ekonomi Kreatif yang kemudian disingkat Perpres Bekraf. Bekraf bertugas untuk menetapkan kebijakan terhadap ekonomi kreatif. Pembaruan UUHC dan mengesahkan Perpres Bekraf diharapkan dapat memenuhi unsur perlindungan dan pengembangan ekonomi kreatif.The creative economy is closely related to copyright because the development of the creative economy focuses on the creation of goods and services by relying on the skills, talents and creativity that can bring economic benefits to its creators. The creative economy in the AEC era made the fashion copyright vulnerable to piracy because the MEA imposed a single market on ASEAN member countries. Hijacking resulted in the creator experiencing moral loss because he felt his work was not appreciated and material losses because his work has been scattered but did not provide incentives to the creator. The form of copyright protection to the creative economy in the MEA is an evident from the government’s policy of updating the UUHC and the approval of the Presidential Regulation on Bekraf. Bekraf is tasked with establishing policies toward the creative economy. The UUHC renewal and the endorsement of the Presidential Regulation on Bekraf are expected to meet the elements of protection and development of the creative economy.

In the business world and all its competition, debt is not a bad thing for businesses whether small, medium, or even large businesses, as long as the debt can still be paid back. A company is also not immune to the events of debts, and the accounts of these debts are companies called solvable, which means they are able to pay their debts, there is also a company called insolvency, which means the company is unable to pay its debts. For companies that cannot afford to pay their debts, the law has provided instruments for settlement, among others, can follow the rule of law guarantees, or the rule of bankruptcy when the conditions are met. Both of these instruments have their own characteristics. Based on the bankruptcy law, the debtor who is determined to be bankrupt will become ineligible for his property until the bankruptcy is over, also not for the insurance company. Insurance companies that have decided bankruptcy will experience payment constraints for the insured party filing a claim, especially when it is not based on the existence of norms or understanding of good norms. This research is a normative study. The results obtained in this study are the insured party can still get the rights through his claim, and its nature can precede with certain conditions.
