Abstract

Government Regulation Number 40 of 1994 states that a state house is "a building that is owned by the state and functions as a residence or shelter and a means of family development as well as supporting the implementation of the duties of Officials and/or Civil Servants". There are 1,198 state houses owned by the National Research and Innovation Agency, consisting of 930 landed houses and 268 flats. Of the total state houses owned by BRIN, 360 state houses in the form of landed houses are occupied by unauthorized residents. From this data it can be seen that there is still disorder in the occupancy of state houses, especially landed houses. The research method used is a normative juridical approach to explore the applicable provisions and a descriptive approach to assess how law enforcement is implemented regarding this disorder. The steps taken by BRIN in enforcing the law and optimizing management include strengthening the legal basis for management policies, strengthening institutions, disseminating legal regulations, and carrying out control over state houses occupied by unauthorized parties. The application of law enforcement prioritizes using a persuasive approach, except in certain cases and conditions. The results of law enforcement in controlling state houses have shown results, although they are not yet optimal

Abstract

State Property is all goods purchased or obtained at the expense of the APBN and other legitimate acquisitions. There is a condition of State Property in Ministries/Institutions that is less productive, has not been utilized or has less than optimal utilization so that optimization is needed in the form of utilization. Minister of Finance Regulation Number 115/PMK.06/2020 states that utilization is the utilization of State Property that is not used for carrying out the duties and functions of Ministries/Institutions and/or optimizing State Property without changing the ownership status. The research method used is a normative juridical approach to explore applicable provisions and a descriptive approach to assess how optimization of the use of State Property is carried out. There are 6 forms of utilization of State Property which can produce two things, namely budget efficiency and Non-Tax State Revenue. Budget efficiency is obtained from the costs of maintaining and securing State Property and budget efficiency for the construction of buildings, facilities and infrastructure. Utilization of State Property also produces Non-Tax State Revenue as a budgetary function, which is one of the instruments of state income outside of tax revenues and grants

Abstract

The management of State-Owned Property in the form of State Houses towards orderly and accountable management requires eflorts to organize its management. There are several problems encountered related to the management of State-Owned Property in the form of State Houses. The government has issued laws and regulations concerning the Management of State Property in the form of State Houses which aim to realize the management of State-Owned Property in the form of State Houses that is orderly and accountable. The research method used is a normative legal approach to explore provisions and through literature research/reviews. The rules that must be used in the management of State-Owned Property in the form of State Houses include the steps for managing State-Owned Property in the form of State Houses starting from planning, procurement, occupancy, maintenance, administration, division of authority and responsibility, organizational structure of management, security, and supervision and control. Handling of state assets in the form of State-Owned Property in the form of State Houses that follows the rules of good governance is one of the important basic capitals in preparing accountable reports.

Abstract

Provisions for the management of state houses are regulated by laws and regulations, ranging from laws and regulations to ministerial regulations. However, in the implementation of state houses management, there are still issues that do not comply with these provisions, including physical, administrative, and legal issues. The method or approach used is a scientific study of these issues using a statutory regulatory approach. Efforts to mitigate these issues to support the realization of orderly physical, administrative, legal, targeted, and accountable state houses management can be carried out by strengthening the legal basis through the development of internal regulations, increasing legal awareness among stakeholders, law enforcement, increased supervision and control of state assets for retired or transferred employees, and enhanced coordination with relevant ministries.
