Abstract

Ketahanan keluarga menjadi isu penting di tengah tekanan domestik, sosial, ekonomi, dan psikologis yang dihadapi keluarga Muslim perkotaan. Artikel ini menganalisis kontribusi Family Corner berbasis masjid dalam penguatan ketahanan keluarga di lima kecamatan Kota Malang melalui pendekatan sistem Maqashid Syariah Jasser Auda. Penelitian ini merupakan penelitian lapangan kualitatif dengan desain multisitus pada lima masjid, yaitu Masjid Agung Jami’ Klojen, Masjid Darul Istiqomah Blimbing, Masjid Jami’ Shirotol Mustaqim Lowokwaru, Masjid Al-Ikhsan Sukun, dan Masjid Nashruddin Kedungkandang. Data diperoleh melalui wawancara mendalam dengan pengurus dan konselor Family Corner, didukung dokumen program dan regulasi terkait. Hasil penelitian menunjukkan bahwa Family Corner berkontribusi secara terukur dan kontekstual melalui peningkatan literasi keluarga, edukasi pranikah, mediasi awal konflik rumah tangga, pendampingan pola asuh, serta penyediaan ruang konsultasi sosial-keagamaan yang mudah diakses jamaah. Corak peran tiap masjid berbeda: Masjid Agung Jami’ menonjol pada literasi dan pengajian keluarga; Darul Istiqomah pada mediasi pasangan yang hampir bercerai; Shirotol Mustaqim pada penguatan harmoni sosial warga; Al-Ikhsan pada seminar pencegahan pernikahan dini dan pelatihan konselor; sedangkan Nashruddin pada perluasan akses layanan bagi masyarakat di luar lingkungan masjid. Dalam perspektif Jasser Auda, Family Corner mencerminkan enam fitur sistem maqashid, tetapi implementasinya belum merata. Fitur kognisi, keterbukaan, multidimensionalitas, dan kebermaksudan mulai tampak dalam praktik edukasi dan konseling, sementara fitur kemenyeluruhan dan hierarki interrelasi masih memerlukan penguatan SOP, pencatatan kasus, jejaring rujukan profesional, dan evaluasi dampak. Artikel ini menegaskan bahwa Family Corner bukan sekadar unit penyelesaian konflik, melainkan ekosistem pendukung sosial-keagamaan berbasis masjid yang mengarah pada penjagaan agama, jiwa, akal, keturunan, kehormatan, dan harta, dengan syarat diperkuat secara kelembagaan.

Abstract

The institutional design of state ministries is a central element of Indonesia’s constitutional system because it determines how executive authority is organised, coordinated, and made accountable. Although Article 17 of the 1945 Constitution grants the President authority to establish ministries, political practice shows that cabinet formation is shaped not only by technocratic considerations but also by coalition bargaining within Indonesia’s multiparty presidential system. This study analyses the legal politics of ministerial design, focusing on the tension between constructing a proportional and efficient cabinet and accommodating the political demands of coalition parties. Using doctrinal legal research, this study examines the formation of the Kabinet Merah Putih under President Prabowo Subianto, which consists of 48 ministries, as its main empirical reference. The analysis is conducted through normative mapping of Presidential Regulation Number 139 of 2024 and Law Number 61 of 2024, as well as functional mapping of overlapping ministerial mandates. The findings show that ministerial design in Indonesia is frequently influenced by political pragmatism, producing institutional expansion that may weaken coordination, accountability, fiscal rationality, and functional clarity. This study evaluates ministerial design through five normative criteria: effectiveness, functional proportionality, accountability, conflict-of-interest prevention, and fiscal rationality. The analysis argues that the decisive constitutional issue is not whether ministers come from partisan or non-partisan backgrounds, but whether they possess substantive competence, integrity, and accountability in performing public functions. This study also examines the relevance and limitations of a technocratic cabinet model in Indonesia by comparing practices in Singapore, Germany, Chile, and Uruguay. It argues that Indonesia requires a hybrid cabinet model that combines political representation with technocratic professionalism. Strengthening the legal framework on state ministries is therefore necessary to create a more rational, effective, accountable, and professional cabinet structure aligned with Indonesia’s constitutional objectives while preserving democratic legitimacy and executive coherence in institutional practice.

Abstract

This study aims to reassess the Indonesian presidential electoral system within the context of postcolonial liberal democracy and to propose an alternative democratic framework rooted in the values of siyasah syar'iyyah (Islamic political governance) as part of the decolonization of Islamic politics. The main issues addressed include presidential conflicts of interest during election campaigns, weak electoral oversight institutions, and regulatory ambiguities that allow ethical distortions in democratic practices. The research adopts a normative-juridical approach combined with a conceptual analysis of siyasah shar'iyyah. Data were collected through the examination of electoral laws, academic literature, and classical Islamic political thought such as Al-Ahkam al-Sultaniyyah, Siyasah Syar'iyyah, and Al-Muwafaqat. A qualitative juridical analysis was employed to evaluate the alignment between positive legal norms and the principles of Islamic governance. The findings reveal a fundamental misalignment between Indonesia's electoral practices and the core Islamic political values of justice ('adl), integrity (amanah), and public welfare (maslahah). The phenomenon of presidential intervention in campaigns (cawe-cawe) signifies an ethical leadership crisis, legitimized by vague regulations and weak institutional checks. The study recommends the reconfiguration of Articles 281, 282, and 299 of Law No. 7/2017 as a normative measure to enforce political neutrality and prevent abuse of power. Theoretically, this research contributes to the discourse on decolonization in Islamic political studies and constitutional law. The siyasah syar'iyyah framework provides a more substantive and contextually grounded ethical paradigm than liberal democratic proceduralism and offers a pathway for integrating Islamic values into modern Indonesian political systems.

Abstract

The phenomenon of buying and selling using the coin flip agreement system, which has gone viral on social media, has raised legal issues in Indonesia. This system uses coin tossing to determine the price of goods, creating uncertainty that has the potential to harm one of the parties. This study analyzes the legality of the coin flip practice based on Indonesian positive law using a normative juridical method. The results of the study indicate that although coin flip transactions meet the requirements for a valid agreement under Article 1320 of the Civil Code, this practice distorts the principles of fair and transparent pricing as stipulated in Law No. 8 of 1999 on Consumer Protection. This transaction also contains speculative elements resembling gambling, but Article 303 of the Criminal Code does not explicitly regulate sales and purchases involving elements of chance. From an Islamic law perspective, this practice involves gharar, which contradicts Fatwa DSN-MUI No. 112/2017. The study concludes that there is a legal vacuum in regulating online transactions that involve speculative elements, therefore stricter regulations are needed to ensure legal certainty and consumer protection.
