Abstract

Musik Dangglung merupakan kesenian khas Lumajang tepatnya berasal dari Dusun Pasinan Desa Karangbendo, Kecamatan Tekung, Kabupaten Lumajang. Dangglung dari kata Pandalungan yang artinya perpaduan suku Jawa dan Madura. Saat ini musing Dangglung selain sebagai hiburan, juga sebagai iringan musik religi. Kabupaten Lumajang telah mendaftarkan musik Dangglung sebagai Warisan Budaya Tak Benda ke Kementrian Pendidikan dan Kebudayaan, hal ini merupakan langkah strategis agar musik Dangglung ini mendapatkan legalitas sebagai salah satu kesenian khas Kabupaten Lumajang. Akan tetapi langkah ini belum diimbangi dengan terbentuknya peraturan desa tentang pelestarian musik Dangglung, Metode yang digunakan dalam pengabdian masyarakan ini adalah yuridis empiris/sosiologis yaitu dengan melakukan penelitian di lapangan dengan penggalian sumber bahan hukum berupa observasi dan wawancara yang dilakukan kepada komunitas CIO Indonesian Art Culture yang mengelola musik Dangglung tersebut di Dusun Pasinan tersebut. Topik ini penting dilakukan dengan menggali peran komunitas, peran pemerintah Kabupaten Lumajang dan pemerintah Desa dalam upaya pelestariannya, agar musik Dangglung ini dapat diintegrasikan guna pengembangan potensi desa sekaligus juga dapat dimanfaatkan untuk menciptakan ekonomi kreatif masyarakat sekitar. Peraturan Daerah dan Peraturan Desa perlu dibuat sebagai payung hukum pelestarian musik Dangglung guna memperkuat karakter budaya, pemberdayaan dan daya saing Dusun Pasinan baik pada skala Regional, Nasional maupun Internasional.

Abstract

Digital transformation has led to the implementation of innovations in stamp duty affixation systems, one of which is the application of barcode-based electronic stamps (e-stamps). This research aims to examine the legal certainty regarding the validity of agreements affixed with e-stamps by referring to the Civil Code (KUH Perdata) and the Law on Electronic Information and Transactions (UU ITE). Using a normative juridical research method, it was found that the use of e-stamps is legally valid as proof of duty payment on documents, even though it's not a condition for the validity of an agreement according to Article 1320 of the Civil Code. E-stamps positively contribute to strengthening the proof of digital agreements, including electronic transactions, accelerating administrative processes, and maintaining document integrity and authentication. However, their implementation still faces obstacles such as a lack of public literacy, limited access to technology, and inconsistent acceptance by several institutions. Therefore, clearer technical regulatory support, increased public understanding, and legal reforms are needed so that e-stamps can fully provide legal certainty in the practice of electronic transactions in Indonesia.

Abstract

The presumption of innocence is a fundamental principle in the criminal justice system, ensuring that every individual is considered innocent until proven guilty by a legally binding court decision. However, the application of this principle faces serious challenges in cases of sexual violence, particularly when the victims are individuals with intellectual disabilities (tuna grahita) who experience double vulnerability, both physically, psychologically, and socially. This article aims to analyze how the presumption of innocence is implemented in law enforcement processes and the obstacles encountered when dealing with victims with intellectual disabilities. The research method used is normative juridical with statutory, conceptual, and case approaches. The findings indicate a tension between safeguarding the rights of suspects/defendants and the urgent need for maximum protection of vulnerable victims. The main challenges include limited legal accessibility, insufficient understanding of law enforcement officers regarding disability conditions, and the lack of evidence mechanisms sensitive to persons with intellectual disabilities. Therefore, more comprehensive legal policies are required to balance the presumption of innocence and victim protection principles, through regulatory strengthening, capacity building for law enforcement, and the provision of special assistance for victims with disabilities.
