Abstract

This study aims to analyze the use of e-money from the perspective of maqashid sharia fi al-muamalah, focusing on the types of contracts applied and their legal implications. The research employs a normative legal method with a qualitative approach through library research. The data are derived from primary legal materials, including statutory regulations and fatwas issued by the National Sharia Council of the Indonesian Council of Ulama (DSN-MUI), as well as secondary legal materials such as books and scholarly journal articles related to Islamic economic law and maqashid sharia. The findings indicate that the use of e-money is generally permissible in Islam as long as it complies with sharia principles. The contracts applied in e-money transactions include wadiah or qardh between issuers and users, as well as ijarah, juā€˜alah, or wakalah bi al-ujrah in transactions involving payment system service providers. From the perspective of maqashid sharia, e-money supports the objective of protecting wealth (hifz al-mal) and promotes public benefit in muamalah transactions. Nevertheless, the implementation of e-money must avoid elements of riba, gharar, and maisir to remain consistent with sharia objectives.
