<![CDATA[Abstrak: Penelitian ini bertujuan untuk untuk mengetahui pengaturan tindak pidana pemalsuan identitas berbasis Artificial Intelligence (AI) dalam KUHP 2023 serta untuk mengetahui bentuk optimalisasiperlindungan korban tindak pidana pemalsuan identitas berbasis Artificial Intelligence (AI) yang selaras paradigma baru hukum pidana. Penelitian ini menggunakan pendekatan kualitatif dengan analisis hukum normative, yang menelaah ketentuan hukum yakni KUHP 2023 atau KUHP Nasional terkait perlindungan korban tindak pidana pemalsuan identitas dengan AI serta perbandingan ketentuan hukum dengan negara lain yang telah mencantumkan dan memberikan definisi jelas terkait AI termasuk di dalamnya definisi teknologi deepfake. Hasil penelitian menunjukkan bahwa KUHP 2023 belum secara tersurat mengatur mengenai tindak pidana pemalsuan identitas dengan AI sehingga implikasinya akan dianggap kurang optimal. Kejelasan unsur serta definisi AI diperlukan sebagai bentuk perlindungan hukum terhadap korban. Selain itu, pembentukan Undang-Undang khusus AI sebagai bentuk optimal perlindungan korban karena di dalamnya akan mengatur pembatasan penggunaan AI, melihat ketentuan hukum negara lain telah dengan jelas mengatur mengenai tindak pidana pemalsuan identitas dengan AI. Paradigma baru hukum pidana keadilan restorative merujuk pada perbaikan sisi korban akan berjalan mudah selaras dengan spesifikasi dan transparanasi terkait ketentuan hukum pidana pemalsuan identitas dengan AI.Kata Kunci: Perlindungan Korban, Pemalsuan Identitas, Kecerdasan ArtifisialAbstract: This study aims to determine the regulation of criminal acts of identity forgery based on Artificial Intelligence (AI) in the Criminal Code 2023 and to determine the form of optimization of victim protection of criminal acts of identity forgery based on Artificial Intelligence (AI) in line with the new paradigm of criminal law. This research uses a qualitative approach with normative legal analysis, which examines the legal provisions, namely the Criminal Code 2023 or the National Criminal Code related to the protection of victims of criminal acts of identity forgery with AI as well as a comparison of legal provisions with other countries that have included and provided clear definitions related to AI including the definition of deepfaketechnology. The results show that the Criminal Code 2023 has not explicitly regulated the criminal offense of identity forgery with AI so that the implications will be considered less than optimal. Clarity of theelements and definition of AI is needed as a form of legal protection for victims. In addition, the establishment of a special law on AI is an optimal form of victim protection because it will regulate restrictions on the use of AI, seeing that the legal provisions of other countries have clearly regulated the criminal act of identity forgery with AI. The new paradigm of restorative justice criminal law refers to theimprovement of the victim's side will run easily in line with the specifications and transparency related to the criminal law provisions of identity forgery with AI.Keywords: Victim Protection, Identity Forgery, Artificial Intelligence ]]>
