Abstract

The digital trade sector has grown rapidly as a result of advancements in IT, including the e-commerce drop-shipping approach. Drop-shipping is a business practice in which a company sells products without keeping stock; instead, they order the product from a third party after receiving a customer order. This study analyzes Islamic law for dropshipping e- commerce in Indonesia, although this method is becoming increasingly popular due to its ease and success. There are many questions about its legitimacy according to Islamic law, especially concerning the principles of honesty, ownership of goods, and the prohibition of gharar. A normative approach was used to conduct this study. It included qualitative analysis of literature related to fiqh muamalah, fatwas of scholars, and regulations.Keywords : Dropshipping, E-commerce, Fiqh Muamalah, Gharar, Islamic Law

Abstract

This conceptual paper addresses the critical gap between the global demand for operational efficiency and the increasing need for value-based, ethically guided business practices, particularly within the context of the Indonesian Halal industry. The study aims to formulate a integrating Lean Management principles with the goals of Maqashid Syariah. Employing a theoretical synthesis method based on an analytical review of Indonesian scholarly literature published between 2021 and 2025, the research establishes a robust conceptual synergy. The findings demonstrate that Lean methodologies serve as the precise operational mechanism for achieving the ethical objectives of Syariah. Specifically, the elimination of waste (Muda) directly supports Hifz al-Mal (protection of wealth) by preventing Tabzir (extravagance), while the Lean philosophy of Respect for People aligns with Hifz al-Nafs (protection of life/welfare). Furthermore, the core principle of continuous improvement (Kaizen) finds its spiritual anchor in the Islamic ethos of Ihsan and Itqan (professional excellence). This framework posits that Maqashid Syariah must function as the comprehensive governance pillar guiding all operational decisions, ensuring that efficiency efforts lead to widespread Maslahah (public welfare). The primary contribution is a sustainable, ethical model of Operational Excellence that necessitates a new system of measurement, the Maslahah Index, to track both economic productivity and moral accountability.Keywords : Lean Management, Maqashid Syariah, Operational Excellence, Maslahah, Kaizen, Hifz al-Mal, Conceptual Framework

Abstract

This study aims to philosophically analyze the position of Fiqh within the structure of Islamic knowledge, specifically regarding the duality of Islamic Law between Sharia (which is absolute) and Fiqh (which is the product of Ijtihad, or relative). This research employs the philosophy of science approach, focusing on three pillars: ontology (nature), epistemology (method), and axiology (value). Ontologically, Fiqh serves as a bridge connecting the metaphysical reality of Divine law with empirical human actions, thereby rejecting Western reductionism. Epistemologically, Fiqh is validated through the integrative methodology of Ijtihad (combining reason and revelation), consequently producing a plurality of laws (ikhtilaf) in subsidiary matters (furu'iyyah). Axiologically, Fiqh finds its justification in the ultimate objective, which is the Maqasid Sharia (the realization of public benefit). It is concluded that Fiqh occupies a central position as a dynamic and adaptive discipline in social and transactional matters (muamalah), yet remains firmly rooted in the foundational principles of Tauhid guaranteed by the Sharia, thereby providing a significant contribution to the holistic structure of Islamic knowledgeKeywords : Axiology, Epistemology, Fiqh, Maqasid Sharia, Ontology, Philosophy of Law, Sharia.
