Abstract

The self priority phenomenon has shifted Generation Z's marriage readiness from spiritual-collective values toward psychological-materialistic standards driven by social media pressure. This normative legal research aims to analyze this phenomenon using a conceptual approach and a maqasid al-syari‘ah perspective. The findings indicate that delaying marriage for education and career pathways yields substantial benefits based on the maxim of averting harm. Through the maqasid al-syari‘ah framework, this self prioritization fulfills the pillars of hifz al-din (spirituality), hifz al-nafs (mental health), hifz al-nasl (lineage), and hifz al-mal (wealth) to minimize divorce risks. Theoretically, this study aligns the transition characteristics of emerging adulthood by formulating "Contemporary Pre-Marital Jurisprudence based on Self-Actualization." Practically, it recommends a new counseling model within the KUA that integrates a digital literacy curriculum (digital relationship wellbeing) and pre-marital mental health screening to foster adaptive family resilience.

Abstract

Women's financial independence in the modern era often triggers a masculinity identity crisis in men due to traditional gender ideology clashes. This study aims to analyze men's perceptions and anxieties regarding domestic economic inequality through contemporary Islamic Family Law. This qualitative thematic study utilized in-depth interviews with three Muslim men selected via purposive sampling until data saturation was reached. The findings reveal that men's anxieties stem from fears of losing domestic authority, reduced appreciation, and social pressure. However, Islamic law through independent property rights, proportional maintenance (nafkah), and a functional qiwāmah affirms that a husband's leadership is not automatically invalidated by income disparities. The novelty lies in shifting the gender studies focus from a female-centered view to male psychological burdens, demonstrating that men's concerns toward more established women are heavily influenced by patriarchal social constructions rather than normative Islamic principles. Implicitly, this study offers an equal partnership resolution for dual-earner couples and serves as a contextual guide for marriage counselors in applying nafkah and qiwāmah.

Abstract

Marriages that are not officially registered (sirri) cause problems in the national legal system, especially regarding the determination of the nasab and inheritance rights of children born. The Constitutional Court Decision No. 46/PUU-VIII/2010 grants civil recognition to out-of-wedlock children against their biological fathers, which juridically expands legal protection. However, this provision creates normative tension with the principles of Islamic law that emphasize the importance of clarity of nasab through legal marriage. This study aims to analyze the relevance and application of the concept of saddu dzariah in the context of the distribution of inheritance for children from unrecorded marriage. The method used is qualitative with a normative and descriptive-analytical approach. Data was collected through literature studies that included court decisions, laws and regulations, classical fiqh books, and contemporary legal literature as primary, secondary, and tertiary sources. The results of the study show that the concept of saddu dzariah plays a preventive mechanism in maintaining the clarity of the nasab and preventing the social harm (mafsadah) caused by the practice of unrecorded marriage. Although national law prioritizes substantive justice, this principle remains relevant as a moral and spiritual basis in the formation of Islamic inheritance norms that are in line with the main purpose of sharia (maqasid sharia). These findings underscore the importance of integration between positive law and Islamic law principles in building a fair and sustainable inheritance law system.

Abstract

One of a husband’s primary responsibilities is to provide financial support for his family. Yet not all husbands are able to fulfill this duty adequately, leading to weakened household economies and compelling wives to contribute as breadwinners. This phenomenon is evident among the families of workers at the synthetic hair factory in Purbalingga Regency, where many wives assume the role of principal income earner to meet their household needs. This study aims to identify the factors that drive wives to become the main breadwinners, particularly within the families of factory employees in Purbalingga, examine the effects of this role on marital cohesion, and explore the Islamic perspective on wives as primary providers. Employing a qualitative case-study approach, the research reveals three key findings: (1) economic necessity, stemming from insufficient spousal income, and instances of husbands being unable to work due to illness or by mutual agreement compel wives to take on earning responsibilities; (2) while wives’ income-generating role can enhance family welfare stability, it may also reduce family quality time, create a double burden of domestic and economic duties, hinder communication effectiveness, and heighten role-imbalance conflicts; and (3) within Islamic jurisprudence, wives are permitted to seek livelihood support when their husbands’ earnings fall short, provided they observe Shariah-compliant conditions and limitations; however, any contravention of these religious guidelines renders such work impermissible.
