Abstract

This article examines the reformulation of maqāṣid al-sharī‘ah by integrating Ibn ‘Ashur’s concept of freedom with Jasser Auda’s systems approach, particularly in relation to human rights and gender issues. The study employs a library research method with conceptual and comparative analysis. The findings indicate that Ibn ‘Ashur’s concept of freedom expands maqāṣid beyond a merely protective framework to emphasize autonomy, participation, and human dignity. Meanwhile, Auda’s systems approach provides a more dynamic and context-sensitive method for interpreting Islamic law in response to evolving social realities. The integration of these two perspectives results in a more adaptive, humanistic maqāṣid paradigm oriented toward justice and equality in the modern context.
