Abstract

Abstract: The purpose of this research is that divorce is the process of ending a marital relationship between a man and a woman as husband and wife, carried out in court. However, if police members frequently experience conflicts in their married life that threaten the integrity of their household, it must be immediately reported to Ankum (the superior authorized to take disciplinary action) so that corrective measures can be taken. For police members, the regulation regarding the authorized official who can grant a divorce permit according to Police Regulation Number 6 of 2018 at the Police Resort level is the Chief of Police Resort (Kapolres) for ranks of Brigadier and Civil Servants in grade II and below in their area. A wife or husband who is not a member of the police still has to inform the superior of their spouse who is a police officer about any divorce plans and family issues. This is because they married a police officer and became part of the police family, so they are automatically bound by police regulations. This research is an empirical legal study. Empirical legal research is commonly referred to as field research, which is research oriented toward collecting empirical data in the field. Thus, the primary data in this study is data taken from the first source in the form of interviews with respondents considered appropriate for data collection. As additional material, there are also written sources, which can be divided into: books, scientific journals, archival sources, personal documents, undergraduate or thesis papers, journals, and official documents. In this study, the author analyzes the implementation of Police Regulation Number 6 of 2018 regarding the Procedures for Filing Divorce for Police Members at the South Sorong Police. From the research results, it was found that filing for divorce by police members requires attention, especially if the divorce petition is filed by a police member who has the status of a civil servant (ASN). In that case, they must obtain permission from their superior before filing for divorce. After getting the permission, the police member can submit a divorce petition according to the applicable legal procedures. The police are advised to complete the required documents, and once complete, a mediation process will be conducted at least 3 times. If no agreement is reached, a Divorce Permit Letter will be issued, signed by the Police Chief, as one of the administrative requirements for civil servants in the police to register the divorce petition in court. Police officers have to submit an official request for divorce permission to the authorized officer, like the Kasatker. Once the request is accepted, the authorized officer will provide guidance to help reconcile the husband and wife. If mediation doesn’t work, the authorized officer will take written statements and analyze them to give a recommendation to the authorized officer. After all the processes are completed, the authorized officer can issue a divorce permission letter so the divorce proceedings can continue in court. Keywords: Divorce Filing, South Sorong Police, Police Officer

Abstract

Abstract: The aim of this research is that the police, as public servants, are expected to perform their duties more professionally and independently. Therefore, in serving the community, they must be ready to help whenever a problem arises. Samapta is a technical police function that carries out preventive tasks to create a conducive security situation by providing protection, guidance, and services to the community. Samapta is often associated with patrols, being present among the people, especially in activity centers, residential areas, and places that require police presence. The competence of Samapta members at the Sorong City Police in carrying out first-response duties at traffic incident sites aims to evaluate how the Samapta members perform their duties according to existing legal regulations, particularly at the Sorong City Police. The practice of handling accidents starts after receiving reports or complaints from the public. Then, some officers will immediately head to the scene to check the report and carry out crime scene processing. The research used is normative-empirical research, which will be carried out by gathering information in the field (Field Research). Normative-empirical research is used to analyze or find out how far regulations or laws are being effectively implemented. Therefore, the research location chosen is at the Sorong City Police Department in Southwest Papua Province. Based on the source, data is divided into two types: primary data, which is data created by the researcher for a specific purpose to solve the problem being handled directly by the researcher from the first source or the place where the research object is conducted, related to the competence of Samapta Polres Sorong members; and secondary data, which is data that has been collected for purposes other than solving the current problem, from literature, articles, journals, and websites on the internet related to the research, to provide explanations, seek interpretations from respondents, or draw conclusions. The authority of Samapta Polres Sorong Kota members in carrying out initial actions at traffic crime scenes emphasizes that Samapta acts as first responders who maintain security, provide assistance, and manage traffic around the scene. Samapta's authority is limited to securing and handling the initial situation, not investigating. The legal process afterward remains the responsibility of the Traffic and Criminal Investigation units. Cross-functional coordination is very important so that handling the crime scene is effective, fast, and according to legal procedures. The role of Samapta can be optimized through ongoing training, improved facilities, and synergy between units at Polres Sorong Kota. Improving the competence of Samapta members at Sorong City Police in handling traffic crime scenes involves a combination of continuous training, adequate facilities, clear SOPs, and cross-unit coordination. With these steps, handling traffic accidents will be more professional, faster, and lawful, directly impacting public safety and the police's image. Keywords: Samapta, Sorong City Police, Competence, Traffic Incidents.

Abstract

Abstract: The purpose of this st  udy is about the Regional Inspectorate for Supervision, one of the strategic work units under the West South Papua Regional Police, which is tasked with conducting supervision and internal control within the police environment. As part of the police internal supervision system, Itwasda plays an important role in maintaining performance quality, discipline, accountability, as well as compliance with laws and operational standards within the regional police. With Itwasda in place, it is hoped that the handling process of criminal acts in the West South Papua Regional Police can run more transparently and professionally, thereby increasing public trust in the police. The Regional Supervision Inspectorate (Itwasda) of the West South Papua Police acts as an internal oversight body that conducts audits, reviews, evaluations, monitoring, and handles public complaints. This oversight function isn’t just about punishing violations; it’s also preventive and educational, aimed at guiding police officers to be more disciplined, professional, and have integrity. Normative-empirical research is used to analyze or find out how far regulations or laws are running effectively. This research was carried out at the Southwest Papua Regional Police. Data obtained directly from interviews with the community is called primary data, while data coming from library materials is called secondary data. Literature studies are conducted to get the latest information that’s related to the research problem, and in interviews, the researcher will have a dialogue or talk directly with informants about the research topic. The research findings show that the regional supervisory inspectorate is capable of carrying out its duties and functions in overseeing the actions of police officers. As the coordinator for handling all public complaints, the regional supervisory inspectorate has performed its role well, even though there is a main issue, which is the quite unpredictable and long time required to resolve public complaints. The handling of public complaints by the regional supervisory inspectorate has been done properly; however, there is a need to expand the authority of the regional supervisory inspectorate in carrying out its supervisory function regarding members suspected or alleged to have violated KEPP and/or the law. The obstacles found in the research are: mechanisms that are not streamlined, bureaucratic errors from the relevant units, the number of subbag dumasan members is insufficient compared to the overall tasks they have, discomfort in handling and taking action against colleagues, the public who do not understand the dumas mechanism, and the complicated process from investigation to making a decision. Keywords: Itwasda, Police Members, Southwest Papua.

Abstract

Abstract: The purpose of this research is to look at the police as a state tool with duties to maintain security and order, enforce the law, and provide protection, guidance, and services to the community. Proper crowd control actions are very important so that the goal of creating security can be achieved without violating the rights of people taking part in demonstrations. The Chief of Police Regulation Number 16 of 2006 covers procedures for crowd control, the rights and obligations of officers, and limits on the use of force. Uncontrolled actions can risk human rights violations, such as physical violence against participants who might just be expressing their dissatisfaction peacefully. Therefore, it's really important to identify the existing legal limits when it comes to crowd control. The anarchic protest case in Sorong City shows that the potential for social conflict is very high if political issues and policies are not managed properly, but a humanistic and dialogic approach is still needed so that handling it doesn't lead to more casualties. Empirical legal research was carried out by going directly to the research site at Battalion B Pelopor Satbrimob, West Papua Regional Police, Tanjung Kasuari, West Sorong District, Sorong City. Primary data was obtained directly from respondents about the subject being studied through observation and interviews. Secondary data was obtained from official documents, books related to the research subject, while tertiary data provided guidance or explanations for primary and secondary data. The data and information collected from the research on handling mass demonstrations in Sorong City were then analyzed descriptively and qualitatively, which is a method of data analysis by grouping and selecting the data obtained from the research according to its quality and accuracy. The research findings show that the presence of Brimob as an operational control support (BKO) force boosts the local authorities' resilience in handling large demonstrations. Brimob not only carries out enforcement actions but also plays a role in preventing demonstrations from escalating into riots, maintaining public order, protecting the community, and ensuring that citizens can continue their activities safely despite the protest. Brimob acts as a security stabilizer in Sorong, focusing not only on crowd dispersal but also on conflict escalation prevention and community protection. However, this poses significant risks for both protesters and officers who do not follow procedures, such as using tactical vehicles to chase crowds, which can cause casualties and damage the institution's image. Keywords: Handling, Mass Demonstrations, Mobile Brigade, in Sorong City.
