Abstract

This study aims to re-examine the alignment and potential discrepancies between the Aceh Jinayat legal provisions and international human rights instruments such as the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR), and the Convention Against Torture (CAT). This research employs a library research method with a qualitative approach and a normative-comparative analysis. The primary data in this study consist of the Aceh Jinayat Qanun and international human rights instruments (UDHR, ICCPR, and CAT), while secondary data include academic literature, scholarly journals, and relevant reports from human rights institutions. The findings indicate that there is a degree of compatibility between the Aceh Jinayat law and international human rights standards in terms of moral protection, social order, and the enforcement of public ethics. However, several provisions require strengthening and reformulation based on the principles of substantive justice, proportionality, and human rights protection.

Abstract

This research is motivated by the increasing environmental degradation as a systemic crime and the weak enforcement of environmental law in Indonesia, which remains legal-formal without ethical and moral approaches. The aim of this study is to construct green crime as a delict in Islamic criminal law and to assess its relevance to national environmental law. This research employs a library research method with a normative-conceptual approach, analyzing data from the Qur'an, hadith, fiqh jinayah, maqāṣid al-shariah, and modern criminology literature. The main findings indicate that green crime can be constructed through the expansion of the meaning of fasād fi al-arḍ and the reinterpretation of the elements of jarīmah (actus reus and mens rea) to include systemic ecological damage. This concept is reinforced by maqāṣid al-shariah, particularly the protection of life, property, lineage, and the environment (ḥifẓ al-bi'ah). This research contributes to expanding contemporary fiqh jinayah and offers the integration of Islamic values into Indonesian environmental legal policies toward greater ecological justice.

Abstract

This study examines the legal framework of Indonesia's mandatory halal certification policy ahead of the 2026 implementation deadline, identifies the factors influencing the compliance of micro, small, and medium enterprises (MSMEs), and formulates a responsive law enforcement model for East Aceh Regency. The research employs a normative legal method supported by limited empirical data, using statutory, conceptual, and case approaches to analyze relevant regulations, scholarly literature, and field information. The findings indicate that the post-2024 legal framework has strengthened legal certainty and expanded access to halal certification. However, MSME compliance continues to be influenced by legal literacy, administrative capacity, documentation, perceptions of cost and procedural complexity, and the uneven availability of assistance. The study proposes a responsive enforcement pyramid that emphasizes public outreach, assisted compliance, corrective warnings, proportionate administrative sanctions, and targeted enforcement against repeated violations. It contributes a responsive law enforcement model that balances legal certainty with MSME empowerment, thereby strengthening consumer protection and supporting the more effective implementation of Indonesia's mandatory halal certification policy.
