Abstract

Fenomena "tajam ke bawah, tumpul ke atas" menunjukkan adanya kesenjangan lebar antara das sollen (tujuan hukum ideal) dan das sein (realitas empiris) dalam sistem peradilan pidana di Indonesia. Penelitian ini menganalisis akar penyebab, pola manifestasi, dan dampak sosiologis dari ketimpangan hukum tersebut menggunakan pendekatan yuridis-normatif dan sosiologi hukum. Hasil penelitian mengungkapkan bahwa diskriminasi hukum dipicu oleh dominasi positivisme hukum yang kaku (legal-formalistik), lemahnya integritas aparat akibat kultur koruptif (seperti suap hakim pada kasus Ronald Tannur), intervensi politik, serta penyalahgunaan ruang subjektivitas keyakinan hakim dalam Pasal 183 KUHAP. Akibatnya, kelompok elit pelaku kejahatan luar biasa (koruptor dan pengemudi kaya) kerap mendapat kelunakan hukum, sedangkan masyarakat non-privilege pelaku pelanggaran minor (seperti Nenek Minah dan sopir truk) direspons secara represif. Runtuhnya marwah hukum sebagai tool of social engineering ini berdampak pada krisis kepercayaan publik dan maraknya aksi main hakim sendiri (vigilantism). Penelitian ini menyimpulkan bahwa pemulihan supremasi hukum memerlukan reformasi budaya hukum (legal culture), penerapan hukum progresif yang berorientasi pada keadilan substantif, serta revitalisasi nilai Pancasila.

Abstract

Sexual violence in higher education is increasingly rampant, threatening victims' physical, mental, and academic well-being. Despite its fatal impacts, most cases go unreported due to social pressure, stigma, fear of revictimization, and a lack of trust in institutional protection systems. This study examines the triggering factors of sexual violence such as patriarchal power imbalances its consequences, and the role of regulations in protecting victims in Indonesia. The results emphasize the need for the effective implementation of Law No. 12 of 2022 (UU TPKS) and the Minister of Education, Culture, Research, and Technology Regulation No. 30 of 2021. Furthermore, it highlights the importance of the massive establishment of PPKS Task Forces, the optimization of state institutions (Komnas Perempuan and KPAI), and the strengthening of student solidarity to create a campus environment that is safe and responsive to victim recovery.

Abstract

The alleged case of child abuse at Daycare Little Aresha Yogyakarta has become a concerning issue and shows that childcare institutions have not yet fully become safe spaces for children. This study aims to analyze the case through the perspectives of child protection, victimology, institutional supervision, and the legal responsibility of daycare management. The method used is a literature study by reviewing scientific journals as supporting sources for analysis and using news reports as case data. The focus of this study includes child protection, the impact of violence on children, weak institutional supervision, and the importance of caregiver capacity in implementing child-friendly care. The findings show that violence in daycare can affect children’s physical, psychological, and social conditions. In addition, the imbalance of power relations between caregivers and children, weak licensing systems, and lack of supervision are factors that increase the risk of violence. Therefore, improving caregiver capacity, strengthening regulations, conducting regular supervision, and ensuring victim recovery are important steps in creating a safe, professional daycare environment that supports children’s optimal growth and development.

Abstract

The spread of hoaxes on social media has become one of the major challenges in achieving digital citizenship in Indonesia. This study aims to determine the level of student awareness regarding the dissemination of hoaxes on social media. A descriptive quantitative method with a survey approach was employed, involving 15 students as respondents. Data were collected through an online questionnaire and analyzed descriptively using frequency and percentage distributions. The results indicate that most students have a good level of awareness regarding hoaxes. They are able to identify false information, verify information before sharing it, and understand the negative impacts of hoaxes on society. In addition, students are aware of their role as responsible digital citizens in preventing the spread of false information. These findings suggest that digital literacy plays an important role in fostering critical and responsible attitudes in the use of social media. Therefore, strengthening digital literacy should continue to be promoted to support the creation of a healthy and responsible digital environment.
