Abstract

The examination of notary employees as instrumentary witnesses in criminal investigations often triggers conflicts between investigative authority and the obligation to maintain professional secrecy. Normatively, instrumentary witnesses only verify the formal execution of authentic deeds and are not privy to their legal substance. In practice, however, interrogations frequently exceed these formal limits. This study aims to analyze the discrepancy between norms and practices, while formulating a concrete legal protection model for these witnesses. Employing normative legal research with statutory and conceptual approaches, the study reveals that the current vulnerability arises from a distinct regulatory vacuum: neither the Indonesian Notary Act (UUJN) nor the Criminal Procedure Code (KUHAP) grants explicit procedural safeguards or a derivative right of refusal (hak ingkar) to notarial staff. To bridge this gap, this article establishes its academic novelty by proposing a “Derivative Protection Model.” This model advocates for extending the Notary Honor Council’s (MKN) protective mandate to instrumentary witnesses and institutionalizing a derivative hak ingkar within procedural law, ensuring a balanced synergy between criminal law enforcement and the sanctity of notarial confidentiality.

Abstract

Penelitian ini bertujuan menelaah sejauh mana efektivitas perlindungan hukum terhadap desain kerajinan ketak, sebuah produk tradisional khas Pulau Lombok yang bernilai artistik dan ekonomis bagi para pendesain maupun pengrajinnya. Kemajuan teknologi informasi yang pesat di era digital telah mendorong pemasaran produk melalui jejaring sosial dan platform perdagangan elektronik, namun sekaligus memperhadapkan para pendesain pada risiko yang lebih besar berupa peniruan, penggandaan, dan penyalahgunaan desain tanpa izin pemiliknya. Karakteristik desain kerajinan ketak yang relatif mudah disalin berpotensi menimbulkan kerugian baik secara ekonomi maupun moral bagi pendesain. Instrumen perlindungan hukum tersedia melalui rezim Hak Kekayaan Intelektual, khususnya lewat mekanisme perlindungan desain industri berdasarkan Undang-Undang Nomor 31 Tahun 2000 dan Peraturan Pemerintah Nomor 56 Tahun 2022. Metode yang digunakan dalam penelitian ini adalah hukum normatif-empiris dengan pendekatan perundang-undangan, konseptual, dan sosiologis. Temuan penelitian menunjukkan bahwa perlindungan hukum di Desa Karang Bayan belum berjalan efektif, yang disebabkan oleh rendahnya angka pendaftaran desain, anggapan bahwa prosedur pendaftaran terlampau rumit dan berbiaya mahal, serta kurangnya kesadaran hukum di kalangan masyarakat pengrajin. Atas dasar itu, diperlukan intensifikasi sosialisasi, program edukasi hukum yang berkelanjutan, penguatan peran pemerintah, dan kemudahan akses pendaftaran desain industri bagi pengrajin lokal secara berkesinambungan.
