Biasanya praktek ini dilakukan atas dasar saling percaya yang disebut jual beli di bawah tangan. Asal sudah ada kata sepakat, maka tanah sudah beralih kepemilikannya. Praktek jual beli tanah di bawah tangan ini masih terjadi di Desa Gadingkembar Kecamatan Jabung Kabupaten Malang, Ada beberapa faktor yang menyebabkab masih terjadi praktik jual beli dibawah tangan, sebagian masyarakat di Desa Gadingkembar juga tidak memahami akibat hukum dari praktik jual beli dibawah tangan atas tanah yang masih bersetatus letter C, serta sengketa yang mungkin terjadi di kemudian hari akibat dari jual beli di bawah tangan.Kata Kunci : Jual Beli di bawah tangan, Tanah Letter C AbstractIn the community there is still a lot of practice of buying and selling land that is still in the letter C or not certified.
