Abstract

The reform of family law in Saudi Arabia represents a significant step toward modernizing the national legal system by enhancing legal certainty, family protection, and judicial effectiveness. The enactment of the Personal Status Law in 2022 marked a milestone in the codification of Islamic family law, replacing the previous reliance on judicial interpretations of the Hanbali school. This study aims to analyze the transformation of Islamic family law in Saudi Arabia, identify the driving factors behind legal reform, and examine its implications for the development of contemporary Islamic family law. This research employs normative legal research using statutory, conceptual, historical, and comparative approaches. Legal materials were collected through library research, including legislation, Islamic legal literature, scholarly journals, and official government documents. The data were analyzed descriptively and analytically through the perspectives of legal politics and Maqāṣid al-Sharīʿah. The findings indicate that the reform does not alter the fundamental principles of Islamic law but codifies and standardizes legal norms to strengthen legal certainty, improve the protection of women and children, and enhance the efficiency of family dispute resolution. The reform reflects a process of harmonizing Islamic legal principles with the demands of a modern legal system. This study proposes a codification-based model of Islamic family law transformation as a conceptual contribution to the development of family law in Muslim-majority countries.

Abstract

Transformasi hukum keluarga di negara-negara minoritas Muslim menunjukkan adanya dinamika hubungan antara hukum Islam dengan sistem hukum nasional yang dipengaruhi oleh karakter politik hukum, sejarah, dan pluralisme hukum di masing-masing negara. Penelitian ini bertujuan menganalisis transformasi hukum keluarga Islam dalam sistem hukum Filipina, Vietnam, Singapura, dan Thailand, serta mengidentifikasi persamaan, perbedaan, dan faktor-faktor yang memengaruhi implementasinya. Penelitian menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan hukum. Bahan hukum diperoleh melalui studi kepustakaan yang meliputi peraturan perundang-undangan, putusan pengadilan, buku, serta artikel ilmiah yang relevan. Analisis dilakukan secara deskriptif-analitis dengan membandingkan pengaturan mengenai perkawinan, perceraian, poligami, kewarisan, dan perlindungan hak keluarga pada masing-masing negara. Hasil penelitian menunjukkan bahwa keberadaan hukum keluarga Islam di negara minoritas Muslim tidak bersifat seragam. Filipina memberikan pengakuan khusus terhadap hukum keluarga Islam melalui sistem hukum tersendiri bagi komunitas Muslim, Singapura menerapkan model integrasi melalui lembaga peradilan syariah, sedangkan Vietnam dan Thailand lebih menempatkan hukum negara sebagai hukum yang dominan sehingga penerapan prinsip-prinsip hukum Islam berlangsung secara terbatas. Perbedaan tersebut dipengaruhi oleh konfigurasi politik hukum, tingkat pluralisme hukum, serta kebijakan negara terhadap kebebasan beragama. Penelitian ini menegaskan bahwa transformasi hukum keluarga di negara minoritas Muslim merupakan bentuk adaptasi antara nilai-nilai syariah dengan sistem hukum nasional untuk mewujudkan kepastian hukum, keadilan, dan perlindungan hak masyarakat Muslim.

Abstract

. Contemporary family law in Indonesia has undergone significant transformation due to social change, technological advancement, and increasing awareness of human rights and gender equality. This study aims to analyze the development of contemporary family law within the Indonesian legal system from the perspectives of legal pluralism and legal reform. Employing a normative juridical approach with descriptive-analytical methods, this research examines primary legal materials, including statutory regulations, court decisions, and secondary legal literature. The findings indicate that Indonesian family law reflects a pluralistic legal system integrating state law, Islamic law, and customary law. The interaction among these legal systems has generated various contemporary legal issues, including child marriage, interfaith marriage, domestic violence, children's rights, reproductive technology, gender equality, and legal protection for vulnerable family members. Furthermore, judicial decisions of the Constitutional Court and the Supreme Court have played a significant role in developing new legal norms that promote justice and legal certainty. Nevertheless, challenges remain regarding legal harmonization, gender inequality, and inconsistencies in legal implementation. Therefore, comprehensive family law reform is required to establish a more inclusive, responsive, and justice-oriented legal system capable of addressing contemporary societal developments.
