Abstract

Perkembangan teknologi informasi dan komunikasi telah membawa implikasi ganda bagi anak-anak, di satu sisi memberikan akses informasi dan pembelajaran, namun di sisi lain meningkatkan kerentanan terhadap kejahatan siber. Penelitian ini mengkaji urgensi pembentukan Peraturan Daerah tentang Perlindungan Anak di Ranah Daring di Kota Palu sebagai respons terhadap kekosongan hukum di tingkat daerah. Menggunakan metode penelitian hukum normatif-empiris dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus, penelitian ini menganalisis landasan filosofis, sosiologis, dan yuridis pembentukan regulasi daerah. Hasil penelitian menunjukkan bahwa meskipun Indonesia memiliki berbagai peraturan perundang-undangan terkait perlindungan anak, pengaturan khusus mengenai perlindungan anak di ranah daring masih bersifat parsial dan belum terdapat regulasi komprehensif di tingkat daerah. Kondisi ini diperparah oleh rendahnya literasi digital masyarakat, keterbatasan infrastruktur perlindungan anak daring, dan minimnya koordinasi antarpemangku kepentingan. Penelitian ini menyimpulkan bahwa pembentukan Peraturan Daerah merupakan kebutuhan mendesak untuk memberikan payung hukum bagi program perlindungan anak di ranah daring, dengan ruang lingkup yang mencakup perencanaan, pemenuhan hak anak atas internet, perlindungan khusus, partisipasi masyarakat, pembentukan gugus tugas, sistem informasi, serta pembinaan dan pengawasan yang terintegrasi.

Abstract

In the context of asymmetric decentralization in Indonesia, integrating local wisdom into constitutional policy formulation is increasingly crucial, particularly in regions with distinctive cultural governance systems. This article examines how the Sintuvu principle and Madika system of the Kaili tribe in Central Sulawesi can serve as a normative and strategic model in formulating asymmetric decentralization policies. Using a normative-legal approach combined with socio-legal analysis, this study demonstrates that the Sintuvu tradition (collective cooperation) and the Madika governmental structure constitute a contextual governance system that aligns with principles of responsive law and legal pluralism. The study analyzes the Pali customary law, the Libu nu Maradika deliberative council, and Givu sanction mechanisms as concrete manifestations of local constitutional values. This research argues that asymmetric decentralization in Central Sulawesi should not merely adopt a formalistic approach but must integrate Kaili traditional governance values as a foundation for inclusive, contextual, and culturally-rooted policies. The article recommends a specific policy formulation model based on the Sintuvu principle as the philosophical foundation for regional governance that honors local constitutional identity.

Abstract

This study aims to analyze the implementation of the Kaleke Village Head Regulation (Perkades) No. 1 of 2024 concerning the Spring Water Maintenance and Management System and to examine it from the perspective of Fiqh Ecology. The research employed an empirical juridical method using sociological jurisprudence and statute approach. Data were collected through interviews, observations, and documentation and analyzed qualitatively using descriptive analysis. The findings indicate that the Perkades has been implemented through collaboration among the Village Government, the Village-Owned Enterprise (BUMDes), and the Tourism Awareness Group (Pokdarwis) in Spring Water conservation, water-use monitoring, public education, and conservation fee management. The implementation has been supported by community participation and religious values; however, challenges remain, including unauthorized water extraction using water pumps (alkon), domestic activities around the spring area, suboptimal public compliance, and the need for greater transparency in conservation fund management. From the perspective of Fiqh Ecology, the implementation of the Perkades reflects the principles of tauhid, khalifah, amanah and mas'uliyyah, justice (al-'adl), and the prohibition of environmental destruction (nahy 'an al-fasād). The conservation fee of IDR 1,000 per gallon serves as a conservation financing mechanism rather than a form of commercialization of water.
