Penelitian ini bertujuan untuk menganalisis mekanisme penyelesaian sengketa di luar pengadilan terhadap pelaku tindak pidana kekerasan terhadap anak di Kepolisian Resor Gowa, serta mengidentifikasi faktor-faktor yang menjadi hambatan dalam pelaksanaannya. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, dengan memadukan pendekatan peraturan perundang-undangan dan data lapangan melalui wawancara dengan aparat kepolisian serta pihak-pihak terkait. Hasil penelitian menunjukkan bahwa penyelesaian sengketa di luar pengadilan pada kasus kekerasan terhadap anak di Kepolisian Resor Gowa dilaksanakan melalui pendekatan keadilan restoratif (restorative justice). Proses tersebut meliputi tahapan mediasi yang difasilitasi oleh penyidik, kesepakatan perdamaian antara pelaku dan korban atau keluarganya, serta pemberian ganti rugi sebagai bentuk tanggung jawab pelaku. Mekanisme ini bertujuan untuk menghadirkan keadilan yang berorientasi pada pemulihan (restorative) dan perlindungan terhadap kepentingan terbaik anak, baik dari sisi fisik maupun psikologis. Namun demikian, pelaksanaan penyelesaian sengketa di luar pengadilan masih menghadapi sejumlah hambatan yang bersumber dari tiga aspek utama, yaitu: (1) dari pelaku, yang sering kali tidak mengakui perbuatannya, bersikap tidak kooperatif, atau tidak mampu memberikan ganti rugi karena keterbatasan ekonomi; (2) dari korban, yang menolak upaya mediasi akibat trauma, dorongan emosional untuk menuntut keadilan formal, atau karena menetapkan syarat-syarat yang sulit dipenuhi; serta (3) dari masyarakat, yang memberikan tekanan sosial kepada korban untuk memaafkan atau kepada pelaku untuk dihukum berat, disertai dengan rendahnya pemahaman terhadap prinsip keadilan restoratif dan isu kekerasan terhadap anak. Berdasarkan hasil tersebut, disarankan agar Kepolisian Resor Gowa meningkatkan kapasitas penyidik melalui pelatihan khusus tentang penerapan keadilan restoratif dalam penanganan kasus kekerasan anak, serta memperkuat pemahaman tentang psikologi anak dan teknik komunikasi yang empatik. Langkah ini diharapkan dapat mewujudkan proses penyelesaian yang lebih adil, manusiawi, dan berpihak pada kepentingan terbaik anak sebagai korban. This study aims to analyze the mechanism for out-of-court dispute resolution for perpetrators of child abuse crimes at the Gowa Police Resort, and to identify factors that hinder its implementation. The research method used is normative-empirical legal research, combining a statutory regulatory approach and field data through interviews with police officers and related parties. The results of the study indicate that out-of-court dispute resolution in cases of child abuse at the Gowa Police Resort is implemented through a restorative justice approach. This process includes mediation stages facilitated by investigators, a peace agreement between the perpetrator and the victim or their family, and the provision of compensation as a form of the perpetrator's responsibility. This mechanism aims to provide justice that is oriented towards restorative recovery and the protection of the child's best interests, both physical and psychological. However, the implementation of out-of-court dispute resolution still faces several obstacles originating from three main aspects, namely: (1) from the perpetrator, who often does not admit his actions, is uncooperative, or is unable to provide compensation due to economic limitations; (2) from victims, who reject mediation efforts due to trauma, emotional urges to seek formal justice, or because they impose conditions that are difficult to meet; and (3) from the community, who exert social pressure on victims to forgive or on perpetrators to receive severe punishment, coupled with a low understanding of the principles of restorative justice and the issue of violence against children. Based on these results, it is recommended that the Gowa Police Department increase its investigators' capacity through specialized training on the application of restorative justice in handling child violence cases, as well as by strengthening its understanding of child psychology and empathetic communication techniques. This step is expected to create a more just, humane, and supportive resolution process that prioritizes the best interests of children as victims.
