Abstract

Penelitian ini bertujuan untuk menganalisis bentuk dan pelaksanaan penegakan hukum terhadap anggota Kepolisian Negara Republik Indonesia (Polri) yang melakukan pelanggaran Kode Etik Profesi Polri terkait praktik pungutan liar oleh calo Calon Siswa (Casis) di Kepolisian Daerah Sulawesi Selatan, serta mengidentifikasi faktor-faktor yang menghambat efektivitas penegakan hukum tersebut. Penelitian ini menggunakan metode yuridis normatif yang dipadukan dengan pendekatan empiris, dengan sumber data yang terdiri atas bahan hukum primer berupa peraturan perundang-undangan, kode etik profesi Polri, serta putusan sidang etik, dan bahan hukum sekunder seperti literatur akademik dan hasil penelitian terdahulu. Data empiris diperoleh melalui wawancara dengan aparat penyidik, pejabat Bidang Profesi dan Pengamanan (Propam), serta praktisi hukum di wilayah Polda Sulawesi Selatan. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap pelanggaran kode etik profesi Polri di Polda Sulawesi Selatan telah dilaksanakan melalui mekanisme pemeriksaan internal, sidang kode etik, serta penjatuhan sanksi berupa demosi, mutasi, dan pemberhentian tidak dengan hormat. Namun demikian, efektivitas penerapannya belum optimal karena masih terdapat sejumlah hambatan, seperti rendahnya transparansi proses, kuatnya solidaritas korps (esprit de corps), adanya intervensi pihak eksternal, serta karakter sidang etik yang masih bersifat tertutup dan formalistik. Hambatan-hambatan tersebut mengakibatkan lemahnya efek jera bagi pelanggar dan menurunkan tingkat kepercayaan publik terhadap profesionalisme institusi Polri. Oleh karena itu, diperlukan reformasi sistem penegakan kode etik yang lebih transparan, akuntabel, dan berorientasi pada prinsip-prinsip good governance. This study aims to analyze the form and implementation of law enforcement against members of the Indonesian National Police (Polri) who violate the Police Professional Code of Ethics related to the practice of extortion by prospective student brokers (Casis) in the South Sulawesi Regional Police, and to identify factors that hinder the effectiveness of such law enforcement. This study uses a normative juridical method combined with an empirical approach, with data sources consisting of primary legal materials in the form of laws and regulations, the Polri professional code of ethics, and ethics hearing decisions, and secondary legal materials such as academic literature and previous research results. Empirical data were obtained through interviews with investigators, officials from the Professional and Security Division (Propam), and legal practitioners in the South Sulawesi Regional Police area. The results of the study indicate that law enforcement against violations of the Polri professional code of ethics within the South Sulawesi Regional Police has been implemented through internal inspection mechanisms, code-of-ethics hearings, and the imposition of sanctions, including demotions, transfers, and dishonorable discharges. However, its implementation has not been optimally effective due to several obstacles, such as low process transparency, strong esprit de corps (esprit de corps), external intervention, and the closed and formalistic nature of ethics hearings. These obstacles result in a weak deterrent effect for violators and undermine public trust in the professionalism of the Indonesian National Police (Polri). Therefore, reform of the code of ethics enforcement system is needed to make it more transparent, accountable, and oriented towards the principles of good governance.
