Abstract

Penelitian ini bertujuan untuk menganalisis penerapan prinsip keadilan restoratif dalam penyelesaian tindak pidana penganiayaan di area pertambangan pada wilayah hukum Kepolisian Daerah Sulawesi Barat serta mengidentifikasi kendala yang dihadapi dalam implementasinya. Penelitian ini menggunakan metode penelitian hukum empiris dengan pendekatan kualitatif. Data diperoleh melalui wawancara dengan aparat Kepolisian Daerah Sulawesi Barat dan studi dokumentasi terhadap peraturan perundang-undangan serta dokumen terkait. Hasil penelitian menunjukkan bahwa penerapan keadilan restoratif telah dilaksanakan melalui dialog dan mediasi yang melibatkan pelaku, korban, keluarga, dan aparat penegak hukum. Pendekatan ini mampu mempercepat penyelesaian perkara, memulihkan hubungan sosial para pihak, serta mengurangi potensi kriminalisasi masyarakat yang terlibat dalam konflik di area pertambangan. Penerimaan para pihak terhadap mekanisme keadilan restoratif juga tergolong baik karena penyelesaian dilakukan berdasarkan kesepakatan bersama dan berorientasi pada pemulihan. Adapun kendala yang dihadapi meliputi keterbatasan kapasitas aparat penegak hukum dalam memahami mekanisme keadilan restoratif dan regulasi pertambangan, belum tersedianya pedoman operasional yang memadai, kompleksitas proses penyidikan, serta potensi intervensi dari pihak-pihak yang memiliki kepentingan dalam aktivitas pertambangan. Oleh karena itu, diperlukan penguatan kapasitas aparat penegak hukum dan penyusunan pedoman teknis yang lebih jelas guna mendukung efektivitas penerapan keadilan restoratif. This research aims to analyze the application of restorative justice principles in resolving criminal cases of assault in mining areas within the jurisdiction of the West Sulawesi Regional Police and to identify the obstacles encountered in their implementation. This research uses an empirical legal research method with a qualitative approach. Data were obtained through interviews with officials of the West Sulawesi Regional Police and a documentary study of laws and regulations as well as related documents. The results of the research indicate that restorative justice has been implemented through dialogue and mediation involving perpetrators, victims, families, and law enforcement officials. This approach has been effective in expediting case resolution, restoring social relationships among the parties involved, and reducing the potential for criminalization of communities involved in conflicts within mining areas. The parties’ acceptance of the restorative justice mechanism is also generally positive, as resolutions are based on mutual agreement and focused on restoration. The challenges faced include limited capacity among law enforcement officials to understand restorative justice mechanisms and mining regulations, the lack of adequate operational guidelines, the complexity of the investigative process, and the potential for intervention by parties with vested interests in mining activities. Therefore, it is necessary to strengthen the capacity of law enforcement officials and develop clearer technical guidelines to support the effective implementation of restorative justice.
