Abstract

Artikel ini bertujuan untuk mengkaji perlindungan hukum terhadap kreditur dalam perjanjian kredit dengan cash collateral ketika debitur wanprestasi di PT Bank Rakyat Indonesia (BRI) Cabang Tangerang. Penelitian hukum ini merupakan penelitian hukum empiris, jenis dan sumber data data yang digunakan adalah data primer berupa hasil wawancara serta data sekunder yang berupa bahan hukum primer yaitu ketentuan undang-undang dan bahan hukum sekunder yaitu buku, jurnal, bahan-bahan kepustakaan yang berkaitan dengan penelitian ini. Sifat penelitian yang digunakan adalah penelitian deskriptif analitis dengan menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa dalam pengikatan perjanjian kredit yang dilakukan oleh kreditur dan debitur, terdapat didalamnya suatu klausul mengenai objek jaminan yang diberikan debitur sebagai bentuk dari kesanggupannya untuk melunasi utang seperti cash collateral yang dapat berupa rekening tabungan, bilyet deposito, maupun giro. Perlindungan hukum bagi kreditur dalam hal memberikan fasilitas kredit dengan cash collateral jika debitur wanprestasi terletak pada adanya surat kuasa yang diberikan debitur kepada kreditur untuk mencairkan isi dari cash collateral tersebut sebagai pemenuhan utangnya.

Abstract

AbstractThis article aims to find out the policies used by Bank BTN Solo Branch Office in providing credit relaxation for debtors during the COVID-19 pandemic. This research is empirical legal research and descriptive-analytical. The approach used in this study is qualitative approach. The type of data used is primary data derived from informant interviews at BTN Solo Branch Office as well as secondary data derived from the study of primary and secondary legal materials that use download and copy techniques and then collect, categorize and qualify primary and secondary legal materials as needed based on research objects. The technique of legal material analysis in this study uses sociological/teleological interpretation, systematic interpretation, and uses interactive analysis model. Legal problems arising in number 2 the points of regulation of POJK No. 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy on the Impact of the Spread of COVID-19 there is the word "can" which means not obliging banks to implement it, but giving the option to banks to implement or not relax credit based on these regulations in accordance with the policies of each bank. As a result, the policy was used by Bank BTN Solo Branch Office as a legal basis to provide credit relaxation for debtors affected by COVID-19.

Abstract

This article aims to find out the process of settling share pawn disputes through the Institution of Financial Services Sector Alternative Dispute Resolution (LAPS). The research method used in this article is normative juridical research, with a statue approach. The sources of law materials used in this article are primary and secondary legal materials. The result of this article, show that the pawn dispute settlement process can be carried out in 2 (two) attempts, through the court or outside the court. The Financial Services Authority (OJK) established an Institution of Alternative Dispute Resolution (LAPS) for the Financial Services Sector which integrates with several dispute resolution institutions. Alternative dispute resolution on share pledges outside the court can be done through mediation, arbitration, or adjudication through the Institution of Alternative Dispute Resolution Institution (LAPS) in Financial Services Sector.
