Abstract

The development of digital commerce has created various forms of transactions involving internet-based services, including the practice of selling shared Netflix account access through marketplaces and social media. Such practices generally offer access to Netflix services at a lower price than official subscriptions, but may raise legal issues when the access provided does not comply with Netflix's terms of service or the information provided to consumers. This study aims to analyze the legal protection available to consumers who suffer losses from the practice of selling shared Netflix accounts through Shopee Marketplace and X social media, as well as to examine the legal protection and liability of business actors toward consumers. This research employs normative legal research using statutory and conceptual approaches. Primary legal materials include Law Number 8 of 1999 concerning Consumer Protection, Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, and other relevant legislation. The results indicate that consumers involved in shared Netflix account transactions remain legally protected insofar as the transaction fulfills the legal elements of consumers and business actors. Business actors are required to provide accurate, clear, and honest information concerning the access offered and are responsible for consumer losses when the service provided does not conform to the agreement. Legal protection may be pursued through the fulfillment of consumer rights, compensation, and dispute resolution through non-litigation or litigation mechanisms in accordance with applicable law.
