Abstract

The global shipping sector is undergoing a fundamental digital transformation, adopting technologies like Maritime Autonomous Surface Ships (MASS), big data, and electronic navigation, which promise substantial gains in operational efficiency and safety. Nevertheless, the rapid pace of technological innovation has outpaced the adaptivity of conventional maritime legal frameworks, historically focused on physical safety (SOLAS, STCW) and traditional price competition (e.g., shipping conferences). This research aims to analyze the regulatory developments explicitly addressing maritime digitalization and assess their impact on modern shipping practices. Employing a normative legal research method with content analysis of international instruments (IMO, UNCLOS) and regional policies (EU), the study identifies four critical findings. First, maritime safety has mandatorily expanded to include cyber risk management through IMO Resolution MSC.428(98). Second, competition challenges have shifted from price cartels to the threat of data monopolies controlled by digital platforms. Third, MASS regulation faces serious legal ambiguity concerning liability and jurisdiction under old conventions (COLREGs, STCW). Fourth, there is a major urgency to establish a global data governance framework to overcome legal fragmentation. The implications of these findings highlight the necessity for rapid global standard harmonization and the adoption of proactive, technology-neutral regulation to ensure the shipping sector remains secure, efficient, and competitive in the digital era.

Abstract

This study aims to analyze the factors that affect the determination of freight transportation rates at Bungkutoko Kendari Port. The research method used is a literature study by examining scientific articles, shipping regulations, and sea transportation policies that apply in Indonesia. The analysis was carried out in a descriptive-qualitative manner to identify and examine the main variables that affect the formation of tariffs. The results of the study show that the determination of freight transportation tariffs is influenced by ship operational costs, shipping distance and travel time, port infrastructure conditions, volume and types of goods, government policies, and fuel price fluctuations, where operational costs and government policies are the dominant factors. In addition, the imbalance between the demand and supply of sea transportation services also contributes to the variation in tariffs at Bungkutoko Kendari Port. These findings recommend the need to improve operational efficiency, improve port infrastructure, and adjust adaptive and transparent tariff policies to create a more efficient, competitive, and sustainable freight tariff system.

Abstract

This study aims to analyze the strategic role of the ship scrapping industry in supporting a sustainable maritime circular economy ecosystem. The research employs a qualitative method with a literature review approach, utilizing content analysis of academic journals, industry reports, and international regulations. Data were gathered from various authoritative sources to identify best practices and global standards in ship lifecycle management. The results indicate that the ship scrapping industry serves as a vital hub for secondary material recovery, reducing reliance on virgin raw materials and facilitating global fleet renewal. However, the study finds a significant disparity in the implementation of safety and environmental standards as mandated by the Hong Kong Convention; countries such as Turkey and China lead in compliance, while major recycling hubs in South Asia remain in a transitional phase. As a prominent maritime nation, Indonesia possesses significant potential to integrate this industry into its national circular economy agenda through the development of eco-friendly shipyard infrastructure. This study recommends the synchronization of national regulations with international standards to optimize the potential of the maritime circular economy while mitigating environmental risks associated with ship recycling activities in Indonesia.

Abstract

Sustainable marine ecotourism management requires effective financing planning to maintain the sustainability of coastal ecosystems while improving the quality of tourism services. This study aims to analyze the role of contribution costs incurred by various stakeholders, including local governments, tourist destination managers, and local communities, in supporting sustainable marine ecotourism management in Kendari City. This research uses a qualitative approach with a literature study method, by examining various relevant scientific sources related to the concept of ecotourism, sustainable development, and contribution cost mechanisms in coastal natural resource management. Data was collected through a search of scientific journals, policy reports, and other supporting documents, then analyzed in a descriptive-analytical manner to identify cost allocation patterns and their impact on ecotourism sustainability. The results of the study show that contribution costs allocated in a structured and transparent manner play an important role in strengthening environmental conservation efforts, increasing the attractiveness of tourist destinations, and encouraging the active participation of local communities in preserving marine ecosystems. In addition, multi-stakeholder involvement in ecotourism management financing has been proven to improve management effectiveness and long-term sustainability. This study confirms that proper planning and management of contribution costs is an important foundation in the formulation of sustainable marine ecotourism policies in Kendari City. Therefore, this study recommends the need for the preparation of an integrated, accountable, and participatory contribution fee scheme as the basis for strengthening sustainable marine ecotourism management policies.
