<![CDATA[This research aims to understand the fulfillment of the rights of pregnant female prisoners at the Class II A Correctional Institution in Jember and the views of positive law and Islamic law regarding legal protection for the rights of pregnant female inmates. The research method used is empirical legal research (field research) with a juridical-empirical approach through observation, interviews, and document studies, including photos and documents, to collect accurate data from selected sources.The conclusion of this study is: 1) The fulfillment of rights for pregnant female inmates at Class II A Correctional Institution Jember includes regular health check-ups, provision of supplementary foodand special formula milk for pregnant mothers, and other rights granted according to the institution's capability; 2) The perspective of positive law regulating the rights of pregnant female prisoners focuses on the provision of special food and special treatment, as stated in Law No. 22 of 2022 and Government Regulation No. 32 of 1999, while Islamic law explains protection for the rights of pregnant female prisoners in the form of postponement of detention period or the application of the maqashid shari’ah concept.
Penelitian ini memiliki tujuan untuk mengetahui pemenuhan hakhak narapidana wanita hamil di Lembaga Pemasyarakatan Kelas II A Jember dan pandangan hukum positif serta hukum islam terhadap perlindungan hukum bagi hak narapidana wanita hamil. Metode penelitian yang digunakan dalam penelitian ini ialah metode hukum empiris (field research) atau penelitian lapangan dengan menggunakan pendekatan yuridis empiris melalui observasi, wawancara dan studi dokumentasi baik berupa foto maupun dokumen yang ada untuk pengumpulan data yang akurat dari beberapa narasumber yang dipilih. Kesimpulan dari hasil penelitian ini adalah: 1) pemenuhan hak-hak terhadap narapidana wanita hamil pada LAPAS Kelas II A Jember berupa pemeriksaan kesehatan secara rutin, pemberian makanan tambahan dan susu formula khusus bagi ibu hamil serta hak lainnya yang diberikan atas kemampuan pihak LAPAS 2) perspektif hukum positif yang mengatur terhadap hak-hak narapidana wanita hamil berfokus pada pemberian makanan khusus dan perlakuan khusus tertera dalam UU No. 22 Tahun 2022 dan PP No. 32 Tahun 1999 dan hukum Islam menerangkan perlindungan terhadap hak narapidana wanita hamil berupa penundaan masa tahanan atau penerapan konsep maqashid syari’ah]]>
