Abstract

This study aims to analyze the imposition of court costs on notaries as co-defendants from the perspective of legal justice and to identify the legal remedies available to notaries when such costs are imposed without proof of fault. This research employs a normative juridical method with statutory and conceptual approaches. The findings indicate that the joint imposition of court costs on a notary as a co-defendant who is not proven to have committed any fault does not reflect proportional justice and violates the principle of liability based on fault. Notaries may pursue preventive legal remedies through disqualification objections and repressive remedies through appeal in order to uphold justice, legal certainty, and the integrity of the notarial office.
