Abstract

This study examines the challenges in implementing the rule of law principles in the enforcement of human rights in Indonesia, which have not yet functioned optimally. The main issues addressed include the gap between legal norms and practical implementation, weak independence of law enforcement institutions, regulatory inconsistencies, and low public legal awareness. The purpose of this research is to analyze the factors influencing the effectiveness of human rights enforcement and to propose alternative solutions to strengthen the application of rule of law principles. This study employs a qualitative approach with a normative legal research design based on literature review, utilizing primary, secondary, and tertiary legal sources. The findings indicate that the problems are systemic, involving the interaction of legal structure, legal substance, and legal culture. The analysis reveals that these three major aspects significantly contribute to the weakness in human rights enforcement. This research highlights the need for comprehensive legal reform, improvement in the professionalism of law enforcement officers, and enhancement of public legal awareness to achieve more effective and just human rights protection.
