Abstract

This study examines the customary land dispute between the Ile Pati community and the Bugaliman community in Adonara Barat District, East Flores Regency. The objective is to analyze the legality of land control based on Regent Decree No. 318 of 2024 in relation to Lamaholot customary law and Indonesian civil law, and to identify appropriate dispute resolution mechanisms. This research employs a normative legal method using statutory, conceptual, and case approaches. Legal materials consist of primary, secondary, and tertiary sources analyzed qualitatively. The findings indicate that Bugaliman community’s land occupation lacks legitimacy under customary law due to absence of recognition from Ile Pati customary authority. Under the Civil Code, requirements for lawful ownership and good faith adverse possession are not fulfilled. The Regent Decree is administrative in nature and cannot override existing customary land rights. The study concludes that dispute resolution should prioritize customary deliberation, mediation, and litigation when necessary to ensure legal certainty and social justice.
