Abstract

The development of the Islamic banking industry requires continuous product innovation to meet the growing demands of modern financial transactions while maintaining compliance with Sharia principles. One of the innovations that has gained significant attention is the hybrid contract, which refers to the combination of two or more contracts within a single transaction framework to achieve specific economic objectives. This study aims to analyze the concept of hybrid contracts, their implementation in Islamic banking, the benefits they provide, and the Sharia compliance challenges associated with their application. This research employs a qualitative approach using a library research method, drawing upon the Qur'an, Hadith, DSN-MUI fatwas, Islamic banking regulations, books, and relevant academic literature. The findings reveal that hybrid contracts are generally permissible in Islamic law as long as they do not contradict Sharia principles and each contract involved fulfills its respective legal requirements and conditions. The implementation of hybrid contracts in Islamic banking can be found in products such as murabahah bil wakalah, ijarah muntahiyah bittamlik (IMBT), and multi-service financing schemes. The use of combined contracts offers several advantages, including greater product flexibility, improved transaction efficiency, expanded financial services, and enhanced competitiveness of Islamic banks. However, their application also presents challenges, such as the potential presence of riba, gharar, legal stratagems (hilah), and the complexity of Sharia supervision. Therefore, the development of hybrid contract products requires transparent contract structures, effective supervision, and strict adherence to Sharia principles. This study concludes that hybrid contracts play a strategic role in supporting innovation and the growth of Islamic banking in the modern era, provided they remain aligned with the objectives of Sharia (maqashid al-shariah) and the principle of prudence.

Abstract

Abstrak This study reviews the innovation of Islamic banking products, namely Cash Waqf Linked Deposit (CWLD), as a solution for productive and transparent waqf fund management. The main objective of the research is to examine the legal basis, operational mechanism, as well as the potential and challenges of CWLD development in Indonesia. The method used is library research and descriptive analysis. The results show that CWLD is able to unite the synergy of social and commercial functions of Islamic banks through clear regulations, appropriate sharia contracts, and innovative fund management mechanisms. This product has great potential to expand public participation in cash waqf and support sustainable socio-economic development. Abstract

This study discusses the implementation of the Ijara Muntahiya Vitamrik (IMBT) contract in fundingfor Sharia apartments in Indonesia. IMBT is an agreement that allows the transfer of propertyownership at the end of the rental period in accordance with the principles of fair luxury and Sharia.The aim of this research is to analyze the supporting and inhibiting factors of implementing IMBT inSharia-KPR product innovation, as well as the actual benefits and challenges in Islamic financialinstitutions. The research method used is explanation by collecting data through literature studies,interviews and observations on the implementation of IMB contracts in several Islamic banks. Theresearch results show that the provisions of Bank of Indonesia and DSN-Mui-Fatwa provide a stronglegal basis for the implementation of the IMB Agreement. However, key challenges include realestate value risks, changes in market prices and the need for strict risk management. In addition,social factors and general understanding of IMBT contracts also influence the implementation of thisproduct. With a regulatory framework that supports support and effective risk management, theimplementation of IMBT will increase the integration of Islamic finance and, according to Sharia,provide an alternative for funding. This study is expected to contribute to the development of Islamicfinancial products and increase public satisfaction in choosing sharia-based real estate solutions.Keywords: IMBT, sharia mortgage, ijarah contract, financial flexibility, sharia financial inclusion
