Abstract

 This article would like to explain about Fiqh thought of Asy Syatibi and Ibnu Taimiyah around Islamic Law. These two figures  are  known  as  innovators  in  Islamic  Law.  Asy Syatibi is popular in Granada and his thought in Islamic law  certainly  influenced  by  social  culture  in  Granada.  He applies  the  principle  of  ?Mura?at  al-Khilaf?,  which  is  a principle to honor dissenting opinion in a way that  look at all the opinion as correct. Contrary to Ibnu Taimiyyah, his thought  in  Islamic  law  influenced  by  social  culture  in Damascus.  As  a  result,  the  basic  principle  of  Ibnu Taimiyyah?s fatwa more resemble to Ahmad ibn Hambal?s thought  in  the  use  of  existing  legal    sources.  Neverthless, Ibnu  Taimiyyah  keep  looking  ?illat?  (legal  reasoning)  and base his opinion to that ??illats?.

Abstract

Teroris bukan merupakan bentuk kejahatan kekerasan destruktif biasa, melainkan sudah merupakan kejahatan terhadap perdamaian dan keamanan umat manusia (crimes against peace and security of mankind). Upaya pemberantasan teroris di Indonesia diawali dengan diterbitkannya Pemerintah Indonesia menerbitkan Peraturan Pemerintah Pengganti Undang-Undang (Perpu) No. 1 Tahun 2002. Setahun kemudian, pada tanggal 4 April 2003 Perpu tersebut disahkan menjadi Undang-Undang dengan No. 15 Tahun 2003 tentang Pemberantasan Tindak Pidana Teroris. Pencegahan dan penanggulangan terorisme membutuhkan suatu kejasama secara menyeluruh. Selain kualitas dan kuantitas aparat yang telah dibentuk pemerintah juga perlu adanya dukungan terhadap kepedulian masyarakat. Salah satu, penyebab terjadinya teroris adalah ideologi atau pemahaman agama yang salah dan menyimpang. Oleh karena itu harus ada upaya kontra idiologi teroris khususnya pemahaman tentang jihad yang benar sesuai dengan ajaran agama.

Abstract

Introduction: Khalwat (Seclusion) is a despicable act that violates Islamic law because it leads to adultery. However, Qanun No. 6 of 2014 concerning Jinayat Law stipulates that the settlement of khalwat must go first through the Customary Court so that the punishment applied is not Islamic law punishment, such as ta`zir, but customary punishment.Purposes of the Research: This study aims to analyze the mechanism for resolving the crime of seclusion in Aceh.Methods of the Research: This is normative/doctrinal research using a statutory approach and a comparative approach.Results of the Research: Khalwat is a crime (jarimah) that violates Islamic law and it is categorized into jarimah ta`zir. Settlement of jarimah seclusion can be carried out by litigation through the Syar'iyah Court and the settlement goes to customary courts. However, Article 24 of Qanun Number 6 of 2014 concerning Jinayat Law, stipulates that the settlement of criminal acts of seclusion must first be through customary courts. The settlement mechanism for khalwat is first resolved through customary courts using a deliberation-consensus approach like village meetings, it is usually called Gampong Customary Meetings (RAG) by executing customary punishments such as penalties of paying fines, feasting, bathing, and the khalwat couple is forced to get married. The consideration of implementing customary punishment is to solve the case more effectively and efficiently and in return can raise the level of trust and community compliance.

Abstract

Introduction: Corruption in Indonesia is categorized as an extraordinary crime where an extraordinary measure is needed to give a deterrent effect to the perpetrators.Purposes of the Research:  This study aims at analyzing the various penalties contained in the corruption eradication law as a weight in an effort to reduce the number of corruption in Indonesia.Methods of the Research: This type of research is legalistic, doctrinal or normative. The approach used in normative or legalistic research include a concept approach, a statute approach, historical approach, case approach, and comparative approach. However, this study only uses legal approach since it analyzes the severity of punishment for perpetrators of criminal acts of corruption in Indonesia. The provisions used in this research are Law no. 31 of 1999 jo. Law No. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption and other related laws.Results of the Research: The punishments applied in the law range from imprisonment, additional punishment to the death penalty. In addition, the punishment applied in this provision is in the form of punishment for revocation of political rights, dismissal, and impoverishment. Therefore, the Corruption Eradication Commission does not only use the Corruption Eradication Law in applying these punishments, but also Law no.8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering.
