Abstract

The abuse of residence permits by foreign nationals has become an increasing concern in Southeast Asia due to its connection with immigration violations, transnational crime, and challenges in migration governance. This issue is not limited to administrative violations such as overstaying but also involves the misuse of tourist and business visas, document forgery, and exploitation of legal loopholes for economic or criminal purposes. This study aims to examine the forms, underlying factors, and regulatory challenges related to residence permit abuse in Southeast Asia, with particular attention to Indonesia. This research employs a descriptive qualitative approach through library research by analyzing secondary sources, including academic literature, policy documents, and relevant reports. The findings indicate that residence permit abuse is influenced by various factors, including global mobility, economic inequality, digital migration trends, weak regulatory adaptation, and limited coordination among law enforcement institutions. The study also highlights the influence of social privilege and migrant vulnerability in shaping different experiences of immigration enforcement. Strengthening integrated monitoring systems, improving inter-agency cooperation, and developing adaptive immigration policies are essential to establish a more effective, fair, and sustainable immigration governance framework in Southeast Asia.
