Abstract

This research is motivated by the continued widespread use of Letter C as proof of land ownership, even though the document does not provide legal certainty, especially in disputes, transfer of rights, and economic development. This study aims to analyze the mechanism for converting Letter C into a Certificate of Ownership through a legal system approach that includes substance, structure, and legal culture. In terms of legal substance, the provisions of the Basic Agrarian Law Number 5 of 1960, Government Regulation Number 24 of 1997 concerning Land Registration, and the regulations of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency regarding proof of rights are examined. In terms of legal structure, the role of village officials and the National Land Agency in the conversion process is analyzed. Meanwhile, the legal culture aspect highlights the public perception that Letter C still considers proof of legal ownership. The results of the study indicate that regulations have provided a basis for legal certainty, but their implementation still faces obstacles, such as unorganized village administration, weak historical verification, and low public awareness of the importance of land certification. Therefore, strengthening village administration, digitizing land archives, improving coordination, and public education are needed to achieve more optimal legal certainty.
