Abstract

Artikel ini bertujuan merumuskan model pelayanan kesehatan Islami di Rumah Sakit Muhammadiyah dalam perspektif hukum kesehatan Indonesia. Kajian ini menggunakan metode literature review dengan pendekatan yuridis-normatif dan konseptual. Sumber kajian terdiri atas artikel akademik mengenai pelayanan Islami, rumah sakit syariah, keperawatan Islami, kepuasan pasien, SIRSMA, serta regulasi kesehatan Indonesia, meliputi UU No. 17 Tahun 2023, PP No. 28 Tahun 2024, Permenkes No. 6 Tahun 2026, Permenkes No. 11 Tahun 2017, Permenkes No. 24 Tahun 2022, dan standar akreditasi rumah sakit. Hasil kajian menunjukkan bahwa pelayanan kesehatan Islami di Rumah Sakit Muhammadiyah tidak dapat dipahami hanya sebagai ekspresi simbolik keagamaan, tetapi harus menjadi sistem pelayanan yang mengintegrasikan nilai Al-Islam dan Kemuhammadiyahan dengan hak pasien, keselamatan pasien, mutu layanan, rekam medis, akreditasi, serta tata kelola rumah sakit. Artikel ini menawarkan Model IKHLAS Berbasis Hukum Kesehatan yang terdiri atas integrasi AIK-SIRSMA, kepatuhan hukum, hak pasien, layanan holistik spiritual, akhlak pelayanan, dan sistem mutu-keselamatan pasien. Model ini menegaskan bahwa nilai Islam harus memperkuat, bukan menggantikan, kewajiban hukum rumah sakit. ABSTRACT This article aims to formulate an Islamic healthcare service model for Muhammadiyah Hospitals from the perspective of Indonesian health law. The study employs a literature review method using normative-juridical and conceptual approaches. The sources include academic articles on Islamic healthcare services, Sharia hospitals, Islamic nursing, patient satisfaction, the Muhammadiyah Hospital Management Information System (SIRSMA), and Indonesian health regulations, including Law No. 17 of 2023, Government Regulation No. 28 of 2024, Minister of Health Regulation No. 6 of 2026, Minister of Health Regulation No. 11 of 2017, Minister of Health Regulation No. 24 of 2022, and hospital accreditation standards. The findings indicate that Islamic healthcare services in Muhammadiyah Hospitals should not be understood merely as a symbolic expression of religiosity but rather as a comprehensive service system that integrates Al-Islam and Kemuhammadiyahan (AIK) values with patient rights, patient safety, service quality, medical records, hospital accreditation, and hospital governance. This article proposes the IKHLAS Model Based on Health Law, which comprises the integration of AIK and SIRSMA, legal compliance, patient rights, holistic spiritual care, ethical service conduct, and a quality and patient safety system. The model emphasizes that Islamic values should reinforce, rather than replace, the legal obligations of hospitals.

Abstract

ABSTRAK Perlindungan pasien merupakan isu penting dalam hukum kesehatan karena pasien sering berada pada posisi rentan, baik secara medis, psikologis, ekonomis, maupun informasional. Artikel ini bertujuan menganalisis perlindungan pasien dalam pelayanan kesehatan Indonesia melalui dua perspektif teoritik, yaitu Hukum Kritis dan Hukum Progresif. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Bahan hukum primer yang digunakan meliputi Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, Peraturan Pemerintah Nomor 28 Tahun 2024, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta regulasi mengenai persetujuan tindakan kedokteran dan rekam medis. Hasil kajian menunjukkan bahwa hukum positif Indonesia telah memberikan dasar normatif bagi perlindungan pasien melalui pengakuan hak atas informasi, hak memperoleh pelayanan yang aman dan bermutu, hak menyetujui atau menolak tindakan medis, serta hak atas kerahasiaan data kesehatan. Namun, perspektif Hukum Kritis memperlihatkan bahwa norma hukum tidak selalu cukup mengatasi ketimpangan relasi antara pasien, tenaga medis, fasilitas pelayanan kesehatan, dan negara. Sebaliknya, Hukum Progresif menawarkan orientasi agar hukum tidak berhenti pada teks, melainkan diarahkan pada keadilan substantif, kemanusiaan, dan pemulihan pasien. Artikel ini menyimpulkan bahwa kedua perspektif bersifat komplementer: Hukum Kritis kuat sebagai alat diagnosis ketimpangan, sedangkan Hukum Progresif kuat sebagai orientasi pembaruan perlindungan pasien. ABSTRACT Patient protection is a crucial issue in health law because patients are often vulnerable medically, psychologically, economically, and informationally. This article aims to analyze patient protection in Indonesian healthcare services through two theoretical perspectives: Critical Law and Progressive Law. This study employs a normative legal research method with legislative, conceptual, and comparative approaches. The primary legal materials used include Law Number 17 of 2023 concerning Health, Government Regulation Number 28 of 2024, Law Number 8 of 1999 concerning Consumer Protection, and regulations concerning consent for medical procedures and medical records. The study's findings indicate that Indonesian positive law provides a normative basis for patient protection through the recognition of the right to information, the right to obtain safe and quality services, the right to consent to or refuse medical procedures, and the right to confidentiality of health data. However, the Critical Law perspective demonstrates that legal norms are not always sufficient to address the unequal relations between patients, medical personnel, healthcare facilities, and the state. Conversely, Progressive Law offers an orientation so that the law does not stop at text, but is directed toward substantive justice, humanity, and patient recovery. This article concludes that both perspectives are complementary: Critical Law is strong as a tool for diagnosing inequality, while Progressive Law is strong as an orientation for reforming patient protection.
