Abstract

The formation of Indonesian national law after independence was a long process influenced by political, social, and cultural dynamics, as well as the needs of national development. After the Proclamation of Independence on August 17, 1945, Indonesia faced a major challenge in building a legal system capable of replacing the Dutch colonial law that had been in effect for centuries. Through the Transitional Provisions of the 1945 Constitution, the government continued to enforce most colonial laws to avoid a legal vacuum while gradually establishing national law based on Pancasila and the 1945 Constitution. The journey of national law formation took place through several periods, namely the early independence period, the Old Order, the New Order, and the Reformation. Each period had its own characteristics in the formation of legal products and the direction of national legal policy. This study aims to analyze the history of the formation of Indonesian national law after independence and the factors influencing its development. The research method used is a qualitative method with a literature study approach. The results indicate that the formation of national law is a process of transformation from a colonial legal system to a legal system based on the values of nationality, democracy, social justice, and the rule of law.
