Abstract

Land disputes at the village level still happen quite often, especially concerning ownership, land boundaries, and road access. This study aims to analyze the causes of land disputes and the effectiveness of the Village Head's role as a paralegal in resolving them in Beji Village, Boyolangu District, Tulungagung Regency. The study uses a qualitative method with a descriptive approach and a case study type. Data was collected through interviews, observations, and documentation involving the Village Head, village officials, community leaders, and the disputing parties. Data analysis was done using the Miles and Huberman model with Soerjono Soekanto's legal effectiveness theory. The results show that disputes are triggered by unclear land administration and the lack of re-measurement in the transfer process, resulting in road access ending up on someone else's certificate. The Village Head has acted as a facilitator and mediator through deliberation, However, its implementation hasn't been optimal because it's affected by imbalances in evidence, lack of tracing the chronology of disputes, low public understanding of land administration, and family relationship factors. Therefore, we need to strengthen mediation capacity, improve land administration, and raise public legal awareness to achieve more effective land dispute resolution at the village level.
