Abstract

This study aims to evaluate the effectiveness of urban drainage governance in Semarang City by examining the institutional performance of the Public Works Agency in implementing Minister of Public Works Regulation No. 12/PRT/M/2014, as well as identifying the key constraints affecting its implementation. Urban flooding and waterlogging remain persistent issues, indicating a gap between regulatory mandates and practical outcomes. Employing an empirical juridical approach with a descriptive design, this research integrates normative legal analysis with field data obtained through interviews, observations, and literature review, which are analyzed qualitatively. The results show that although drainage management programs have been formally implemented in accordance with regulatory provisions, their effectiveness remains partial, as evidenced by recurring flooding caused by limited infrastructure capacity, sedimentation, delayed budget allocation, and low levels of community participation. The novelty of this study lies in its integrative analytical framework that connects regulatory compliance with institutional performance, demonstrating that legal effectiveness in infrastructure governance is contingent upon implementation capacity rather than merely normative existence. These findings imply that strengthening urban drainage governance requires performance-based maintenance planning, improved procurement mechanisms, enhanced inter-agency coordination, and institutionalized community participation to ensure sustainable flood risk mitigation.

Abstract

This study aims to analyze the condition and function of green open spaces (RTH) along the West Flood Canal riverbank in Semarang City and to examine the legal responsibility of the local government in its management. Addressing a gap in prior studies that predominantly focus on technical and environmental aspects, this research adopts an empirical juridical method with a socio-legal approach, combining statutory analysis with field data from observations and interviews to evaluate the relationship between normative obligations (das sollen) and implementation realities (das sein). The findings indicate that although Semarang City has formally fulfilled the statutory requirement of 30% green open space, the proportion of accessible public RTH remains significantly below legal standards, revealing a substantive gap between regulatory compliance and functional effectiveness. From the perspective of Hans Kelsen’s theory of legal responsibility, this condition reflects incomplete fulfillment of legal obligations, despite ongoing governmental actions in planning, supervision, and enforcement. The novelty of this study lies in integrating ecological riverbank functions with a doctrinal analysis of municipal accountability, thereby advancing a norm-based framework for evaluating environmental governance. Strengthening green open space management is therefore essential not only for flood mitigation and environmental sustainability but also for ensuring legal accountability and improving urban public welfare.

Abstract

This study aims to analyze the implications of electoral digitalization and disinformation on the quality of democracy in Indonesia, particularly in relation to access to information, voter behavior, and democratic legitimacy. This research is motivated by the rapid development of digital technology, which expands access to electoral information while simultaneously creating vulnerabilities to disinformation that may distort political perceptions and weaken public trust. This study employs a qualitative method using content analysis of scientific literature, policy documents, official election data, and disinformation reports from 2014 to 2024. The novelty of this study lies in its integrative analytical model linking electoral digitalization, disinformation patterns, and democratic legitimacy within a single conceptual framework. The results show that electoral digitalization enhances transparency, efficiency, and public participation as part of procedural democratic strengthening; however, disinformation distorts political information, influences voter behavior, increases social polarization, and reduces institutional trust. This condition affects the quality of substantive democracy, which depends not only on formal procedures but also on the integrity of the information ecosystem. Therefore, strengthening digital literacy, proportional disinformation regulation, and collaboration among election authorities, digital platforms, and civil society are essential to maintain democratic quality in the digital era.   Penelitian ini bertujuan untuk menganalisis implikasi digitalisasi pemilu dan disinformasi terhadap kualitas demokrasi di Indonesia, khususnya dalam kaitannya dengan akses informasi, perilaku pemilih, dan legitimasi demokrasi. Penelitian ini dilatarbelakangi oleh perkembangan teknologi digital yang memperluas akses informasi pemilu sekaligus menciptakan kerentanan terhadap penyebaran disinformasi yang berpotensi mendistorsi persepsi politik dan melemahkan kepercayaan publik. Penelitian ini menggunakan metode kualitatif dengan pendekatan analisis isi terhadap literatur ilmiah, dokumen kebijakan, data resmi penyelenggara pemilu, dan laporan disinformasi selama periode 2014–2024. Kebaruan penelitian ini terletak pada model analisis integratif yang menghubungkan digitalisasi pemilu, pola disinformasi, dan legitimasi demokrasi dalam satu kerangka konseptual. Hasil penelitian menunjukkan bahwa digitalisasi pemilu meningkatkan transparansi, efisiensi, dan partisipasi publik sebagai bagian dari penguatan demokrasi prosedural, namun disinformasi menciptakan distorsi informasi yang memengaruhi perilaku pemilih, meningkatkan polarisasi sosial, dan menurunkan kepercayaan terhadap institusi demokrasi. Kondisi tersebut berdampak pada kualitas demokrasi substantif yang tidak hanya ditentukan oleh prosedur formal, tetapi juga oleh integritas ekosistem informasi. Oleh karena itu, diperlukan penguatan literasi digital, regulasi penanganan disinformasi yang proporsional, serta kolaborasi antara penyelenggara pemilu, platform digital, dan masyarakat sipil untuk menjaga kualitas demokrasi di era digital.
